Warranty complications

My car broke down and called Victor (Jaco gave me his numbers) from the warranty services . They took the car on the 29th Sep 20 for repairs. I was happy and grateful for that and waited for the car to return. Now in my mind I didn't mind them taking their time as long as the car comes back before my work training and fine, I thought since they took it 29 Sep it might be back by end of Oct at least so I didn't bother them.

I've been not going to work since lockdown started (march) with unpaid leave. We were due to start refresher trainings in Nov and I thought the car should be back so I'll be able to go to work. To my surprise the car is not back yet and started to panic and calling just to find out how's the car progress. Fisrt week of Nov when I called I was told they waiting for gearbox to be delivered, and was cool with that and had to make transport arrangements to go to work. The week ended no calls no feedback, so I called again and Victor told me that the clutch also needs fix but I must pay R3800 for it. I did not understand that cause I thought all should be covered, I then told him I've been not going to work and not earning so won't be able to pay that..he told me he'll make a plan for me.

I've been getting super late for my trainings sometimes i skip because of transport issues or when I don't have money for uber. The other day I called and asked if they can't borrow me a car like a cutesy car and he told me no they don't have cars I said okay. Friday 13th Nov I called Victor and he dropped a call on my ear because I questioned the delay and expenses he was telling me about. He told me they still fixing the gearbox and it shocked me cause he once said they were waiting for a gearbox to be delivered, so I asked "you didn't buy a new gearbox ?" He told me they can't buy new one because it cost R48 000 and new clutch is R17 000, i didn't understand that so i kept asking questions and he threatened to make an invoice for me to pay all these expenses then he dropped a call on me. He kept telling me that he's doing me a favor by fixing it. I was really shocked and not happy with his behaviour towards me. Another shock of my life was to hear these ridiculous prices when I know new gearbox for ix35 range around 16 to 18k and clutch around 2 to 3k.

I then decide to call Karin who once helped me when I had a problem of being over charged by Jaco when I was buying the car, Absa told me the car amount I didn't sign for then referred me to Karin. She did resolve that one because i was paid back. I took this matter to her hoping I will get help, she talked to Victor because the next day Victor called me and apologised for his behaviour towards me, this was on the 16th of Nov. He then told me that they waiting for clutch because someone is building and fixing it for him to make it look new and not bother me. I told Karin and Victor I have a trip to EC on the 21st, need to take my kids home before I start my work shifts on the 1st of Dec and i was told the car should be with me by Thursday(19th Nov). I waited and waited as usual and car didn't come back. I called Karin she told me that I must wait If the car is not fixed then there's nothing we can do i just need to wait. I was crying and frustrated on the phone everything just came back to me, all the suffering with my kids, all the uber money I've been spending, getting late for trainings sometimes i was even not accepted in class because I'll be too late, my kids will hav to walk to school sometimes.

That weekend passed and no one cared how I've been and the EC trip situation. This week Monday i called Jaco telling him all this situation and he told me he knows everything and that he even know that I called Karin. So I asked what's going on, he told me that I should ask Victor he's the one who know everything. Victor then told me all they've been waiting came they fitted in the car and run the car but there was noise coming from the gearbox so he had to take it back. Okay bare in mind I have an app to track my car and when engine is ON or OFF...i went to my app and realised the last time the engine was ON was the day I got stuck. I couldn't understand because Victor said the car was running I then thought something wrong with the tracker, so I called my tracker company and they told me wherever the car is the battery is dead because the car has been not running for a long time that's why i can only pick up last time it was ON, they said if the engine was ON we were gonna be able to catch that. This all mean Victor **** to me again, I called him asking this he was so no making sense, he told me the car was running and it's up to me to believe him or tracker and dropped the phone on me. In an hours time he called and said he was talking to his lawyer and InsureAfrica manager that I must decide if I want this car fixed or they call off this whole process bring my car and see what I do with it, I asked you sure about that and which manager did u talk to ? He said "one of the managers" I said to him give me the name, he said he'll go look cause he's lawyer was talking to them and drops the call. Tuesday I told Jaco and Victor that they've been making me a fool and I think i should take this up, Jaco told me to go ahead and that I must not forget that they did me a favour with the car service history. I started questioning why are they fixing same gearbox and clutch and not buying new ones..I was told my cover paid out R20 000 and that won't be enough to buy new things. I went back to check my cover and my cover says I'm covered for up to R35 000 for gearbox and R3000 for clutch. Again this shocked me, I asked when was the pay out/claim and they said they only got this R20 000 on the 04th of Nov. Yesterday called Victor to tell him I had to postpone my trip to EC for this coming weekend I need my car..same story that the gearbox was making sounds it went for fix and not delivered yet...i asked again why they not buying new box he said " Ma'am listen, show me a place were I can get a gearbox for 23k so I go buy it" again said " this 23k of yours will never buy gearbox and helping you here by getting it fixed and fixing clutch because clutch was not covered. I did talk too much, i just jotted all that down, that the pay out has changed from 20k to 23k all of a sudden. Today I'm still hearing same stories and tomorrow evening was planning to go to EC drop my kids because on the 1st of Dec I'm starting my 4am shifts and got no one to take care of kids and don't know how I will get to work cause seems like I'm never getting my car back. It's been 2 months of same stories. I'm even scared that they might do something or create faults that will break the car when I'm driving it....I am so scared don't know what they can do but at the same time I'm now desperate to get my car back cause my job is on the line, I'm about to lose my job because of not having transport to work. Sometimes I feel like they taking advantage of me because I'm a black female, I've been the only one communicating with them. It is very obvious that they never touched my car since 29 Sep till only last week. I do not know what to do anymore, all I wanna know is am I getting my car back or not ? Am I gonna be able to take my kids to EC tomorrow or not ? Am I gonna be able to go to work on the 1 Dec or am I losing my job because of this situation? What is going on ?

Good day Mam'  Our sincere apologies for the late response to your complaint.  The issue that you are describing seems to be an issue with your repairing dealer and as such, this is a matter with yourself and them and/or the selling dealer.  This is a complaint that can be logged with MIOSA.

Hi, your late reply don't matter anymore because one of your agents assisted me. He called me 3 days after my complaint and was very helpful...He is from InsureAfrica. I see I didn't send email to your complaints department I was still not gonna get assistance from you or whoever is responding here since you telling me it is not your problem . But anyway INSUREAFRICA Agent helped me cause it was your matter, he did all I wanted! So thanks!
