My wife's claim on her car is rejected. For this reason " It read “Please note, your next service is due at +/- 163,000km’s or December 2017, whichever occurs first”. The last service carried out by Fix It was carried out on 23/03/2018(163,211km), which is late.

She also ask what does this means in the policy “Servicing requirements It is your responsibility to ensure that the service intervals are maintained as specified by your manufacturer, either on mileage or time, whichever comes first. Services and general maintenance to wear and tear items can be done at either the manufacturer’s, RMI approved or Insureafrica approved workshop. We allow a leeway of 1500 km’s and/or 30 days either side of the service due date. “

They reply the followingThanks for the e-mail.Please re-read that clause you are making reference to so that you get enlightened by the basis of our rejection:-

And the insurer choose to use only the part that rejects the claim.

The response is not helping. " Apologies for the delay in responding to your complaint with regards to the engine claim you are currently experiencing. With regards to the servicing of the vehicle. The vehicle has to be serviced according to manufacturer specifications. As you mentioned the service was due at 163 000 km or December 2017. The vehicle was serviced on 163 000 km in March 2018. As you also pointed out the over run allowed is 30 days or 1500 km either way. Your vehicle was serviced 3 months and 2000 km late. This directly affects your warranty as there would be suspension period in place of 30 days. This suspension period would be applicable from the date we were notified of the late service, which was today " I don’t understand why is 163,211km late by 2 000 km, when the manufacturer specifications state +/- 163,000 and your Servicing requirements allow a leeway of 1500 km’s ? Show me where in the policy when should I notify you of the late service, when the policy says that I do not need to submit my service invoices and keep copies of all invoices for in the event of a claim, that it will be requested. This is a Mechanical failure resulting from fair wear and tear and not failure by age and should be handled as such and not the problem with time . This whole policy lack fairness.
