NON-SUPPLY OF PRODUCT AS ADVERTISED BY INCREDIBLE CONNECTION THROUGH FALSE AND UNJUSTIFIED CLAIMS AND ATTEMPTS TO JUSTIFY THERE ERRORS AND MISTAKES
THIS MATTER IS IN RELATION TO FALSE ADVERTISING AND BREACHING OF THE CPA CONDITIONS WHERE A PRODUCT IS ADVERTISED AND NOT BEING HONORED REGARDING THE SUPPLY TO WHAT WAS ADVERTISED by Incredible Connection (Branch) ENTITY IMPLICATED IN ABOVE MATTER : Incredible Connection is a brand of JD Consumer Electronics and Appliances trading under the registration number ***. We have been dealing with "Ankia van der Pluym-Group Customer Relations Manager"(referred to as IC for IncredibleConnection) who has been totally unfair and non-co-operative with regards to not being honest, fair and co-operative regarding the above where various factual scenarios with documentary evidence were submitted, being avoided and tried to evade to comply with the CPA and their Vision. Mission & Values as set out on their web site (also with reference to "development, and optimisation of customer and supplier relationships, sound levels of customer service, values, ethics ")
The following transpired: I/we visited IC’s Incredible Connection Branch At CradleStone mall/shopping centre, where I approach and dealing with IC’s Staff on Saturday, 07/02/2020 regarding the said item (Huawei P30) displayed on the shelf inside there store (per photo's attached), while looking for a cell phone product (Huawei P30), with no sign indicated any where regarding an incorrect pricing or the selling conditions regarding the in-store products.
Note that IC’s store was approached on the basis of all the above (I.e. Incredible Connection SHELF adverti*****t which lead returning to the same outlet with not honoring of shelf advertised product at discounted price when the goods been requested for supply and payment accordingly).
The IC’s store was approached on the basis of all the above (I.e. Incredible Connection SHELF adverti*****t which lead returning to the same outlet with not honoring of shelf advertised product at discounted price when the goods been requested for supply and payment accordingly).
No correction notices (irrelevant in this matter) was shown to me when dealing with IC’s Incredible Connection Branch(es) / staff during the attempt to purchase the said items (Huawei P30 cell phone for R4'999.00), else a merchandiser/service provider can advertise items at discounted prices to attract clients at random and reflect signs in store that the item(s) is not for sale at the advertised prices - conveniently while the client must bare the brunt, expenses, effort, time and hassle then incurred.
Since requesting to supply the said product at the discounted price various attempts through ridiculous and false claims were made i.e
A last (6th) attempt were mad by IC with a comment " advert IC saw in the store are the exact same specification of the unit on offer, and not of the unit IC are requesting " being incorrect, false and lame, as we again reiterate the pure fact IC’s store advertised the Huawei P30 cell phone NOT Huawei P30 Lite cell phone, as clearly can be seen from the attached advert regarding the same phone. where all the facts regarding the matter were set out step for step with reference to IC’s incorrect, dubious, false attempts and claims I.e.:
First: IC make a claim on the coding (where the client has got nothing to do and should not be involved with IC’s internal policies, processes & codes), being pointed out the immateriality around IC’s claim
Second: IC Now suddenly claim "Huawei P30" as being the "Huawei P30 Lite" being totally false and incorrect, as per IC’s attached advert (Huawei P30 Black sold by Incredible connection - contradiction to what staff informed-***0), being the the exact same cell phone we opted for being the "Huawei P30" as advertised in IC’s store and IC’s website, and thus clearly reflected and NOT the "Huawei P30 Lite"
Third: Why would IC staff go and re-print the adverts (per the attached footage) from "Huawei P30" to "Huawei P30 Lite - if it reflected the exact same item/phone as now suddenly falsely claimed by IC - WHY the changes been made - clear indication IC are and have tried various attempts to avoid IC’s responsibilities and obligation to the customer by also NOT honoring IC’s in-store adverts, as also reflected by IC’s OWN website adverts
Fourth: IC claim the advert did not specify "Huawei P30 Pro", being correct, as the item opted for was the "Huawei P30" as also clearly indicated and reflected as "Huawei P30" also per IC’s OWN website advert (Huawei P30 Black sold by Incredible connection - contradiction to what staff informed-***0) and NOT "Huawei P30 Pro" now claimed by IC the advert should have said to try and justify IC’s claim around the “Huawei P30” - totally disagree and object to IC’s claim in totality.
Fith: IC trying to use the specifications as an excuse - see attach comparison between "Huawei P30 Lite" & "Huawei P30" & "Huawei P30 Pro" ("Compare Huawei P30 lite vs. Huawei P30 vs. Huawei P30 Pro - GSMArena") - again contradicting IC’sself with the attempt (as mentioned above & below under "Fourthly" & "Fourth") where IC claimed "Huawei P30" refers to the "Huawei P30 Pro", where in effect it is 2 total different models YET AGAIN with IC comments not applicable or carrying any weight at all THAT THE ADVERT WERE SUPPOSE TO SHOULD HAVE REFLECTED "Huawei P30 Pro" FOR THE CLAIMED "Huawei P30" - no one could do a comparison as per attached document "Compare Huawei P30 lite vs Huawei P30 vs. Huawei P30 Pro - GSMArena" taking into consideration the phone/screen size/dimensions (needs to be done with measuring tape), the network band capabilities (needs stripping of phone and do test via sophisticated equipment), date launched (have to use Google), Platform/Memory/Camera/Features (needs stripping of phone and do test via sophisticated equipment & use of Google to do research) - totally impossible where the following items of ALL 3 handsets to be exactly/similar in the following specifications :
· NETWORK Technology – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· LAUNCH Announced & Status – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· BODY Dimensions & Weight & Build & SIM – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· DISPLAY Type & Size & Resolution – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· PLATFORM OS & Chipset & CPU – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· MEMORY OS & Chipset & CPU – impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
· CAMERA Modules & Features & Video– impossible to compare unless in-depth knowledge of all handsets on market through proper product & market research (exactly/similar - how is a customer/one to know the detailed differences if any)
**THUS in summary, is and was there NO WAY for a customer to have known the difference in specifications when looking at the item advertised in store with a handset displayed next to the advert with all 3 Huawei P30 handsets appear to be exact/similar in specifications/display
**FURTHER does a client/customer not have to do such an in depth comparison which requires in depth knowledge of handsets in order to determine if the Company/Merchandiser has got the correct item on display with the correct details as advertised - not being possible in any event to have been determined by an ordinary client/customer at the/any time of purchase
**WHERE the facts remain that Incredible Connection (the merchandiser) has made an eror in their in-store advert which is enforsable under the CPA, now being deliberately trying to avoid through scroupilous actions by Ankia van der Pluym Where We AGAIN request and plea to honor what IC advertise and not what and how IC now want to construed and distort the facts at hand, IC (Ankia van der Pluym) clearly being ******** in the facts supp**** and explained to IC in detail with footage, witnesses and documentary proof to the effect.
AGAIN we requested ICF to Please keep up to JD Group m& IC Vision. Mission & Values as set out on IC’s web site (also with reference to "development, and optimisation of customer and supplier relationships, sound levels of customer service, values, ethics ") and comply with the CPA accordingly - which IC (Ankia van der Pluym) clearly is NOT upholding at all, with reference to IC’s responses to deviate matters and with an attempt divert the Companies Responsibility & Accountability + Honesty & Integrity
DON'T GET ******* AND DEVIATED BY IC'S ACTIONS AND RESPONSES - ENSURE YOU FOLLOW THROUGH WITH THE PROCESS IN OBTAINING THE PRODUCTS AS ADVERTISED WITHOUT ALLOWING IC TO TRY AND MANIPULATE THE SITUATION AND SCENARIO TO SUIT THEM IN ORDER NOT TO HONOR THE SUPPLY OF THE PRODUCT AS ADVERTISED
