Review of a rejected Claim

Precise details of complaint

On 26 of December 2021, my brother was traveling from a place called Mojo’s with two ladies who are friends to him, as they were traveling to my brother's place at Seaview Durban, around Cato Minor football fields. He then lost control of the vehicle and crushed it to the concrete side wall, since his phone was off he then requested Thandeka to call Thulisani his friend to inform me about the accident, Thulisa came straight to the place where the accident was. I was driving to Engonyameni when I received a call from the tracker company saying they received an accident or crush signal from my car. I then tried to call my brother Thabani but his phone was off I then tried Thulisani he confirmed to me that there was an accident her the directed me to where the accident was, I drove home and requested my nephew to escort me to the place of the accident. We drove there when we got to the place of the accident, there was a black Golf 5 GTI parking in front of the Red Beetle, behind the Beetle there was a black Bakkie towing track and a white Police vehicle with two Police officers next to the car. I greeted them then went to speak to Thabani asking if he was ok and the people he was traveling with if we were ok, he said he found he did not sustain any injuries and to the ladies also. I then called the insurer to report the accident they assisted me with the towing track and we ended up using the same towing track that was at the place of the accident, I give the towing truck driver my phone he speaks to the person for the insurance office. He then told me that the eventing was sorted and we filled some invoice books and explained to me where was the car going to be. The police officer spoke to Thabani my brother and explained that he need to come to the police station to report the accident and get an ARL number, he then said it can be done on the same day or even the following day since everything was done on my side I then drove back to Engonyamani. The gentlemen by the of Kaylin Naidoo called me and explain that he was the appointed assessor and he request documents from me to give him consent to the full investigation, I then emailed him all the documents that he requested and he said he will call me to interview me and asked for the number of the people who were with Thabani senior, I told him that Thabani sent him a WhatsApp message I want the complaints office to review the rejection of my claim as I believe that the report from the investigative officer is baseless with no conclusive evidence provided on his report. The report stated that my brother was not driving at the time of the accident and the person driving was under the influence of alcohol. I will like the investigator to furnish me with a breathalyzer test and police report from the place of the accident that proves findings stated on the investigative report, as a client I believe I have a right to appeal this decision and I demand that they should be transparency and proper evidence and witness from the accident place should be speculated by the investigator. I believe that my brother's statement or affidavit was not misrepresented as stated by the investing officer. My request is for the report to be reviewed and for the insurer to furnish me with a full report and details of the witness interview by the investigating officer and police report stating that people who were in the car were under the influence of alcohol.
