Retrenchment claim denied
I took a personal loan from ABSA Bank and I also have a credit card with them. I was retrenched on 10 December 2024 and because I have retrenchment insurance on both I registered claims with ABSA Insurance to assist me through this difficult time of unemployment. When I took out the credit card as well as the loan, both were done online and finalized telephonically, therefore I never received the insurance documents from ABSA with all the fine print. I changed jobs in the mean time and because of that I was retrenched 6 days before I was permanently employed by the company. ABSA Insurance now rep**** to my claims with the following: Because I was not yet permanently employed by the company (a company which I worked for for 2 and a half years prior, I was gone for a year and they begged me to come back) they declined both my claims. Is it fair that I be penalized for something that was out of my control as I was retrenched involuntarily on 10 December 2024 as well as everyone else that worked for them? I have never missed a payment. What is the point of insurance if they decline any form of employment contracts and I was not aware thereof as I never received the insurance documents from them. HOW WILL I NOW PAY THESE INSTALLMENTS WITHOUT ANY MEANS OF AN INCOME?
I am not happy as your staff at ABSA are contacting one of my old employers constantly and also sending my personal information as well as account balances to this person.
Surely according to the POPI Act this is not allowed:
What the POPI Act does
- Protects personal information
- The POPI Act protects individuals' personal information from theft, **************, and other harm.
- Sets conditions for processing personal information
- The POPI Act sets conditions for how responsible parties can process personal information.

If I can give anyone some advice, stay away from ABSA. They are quick to help you and take your money, but as soon as you can't pay them because of retrenchment or for any other reason, they turn their backs on you and hand you over to lawyers within the second month of an individual having a valid reason and problem for not paying.

We have assessed the claim lodged under this policy and advise that it has been repudiated due to the current event that you are claiming for not being in line with the policy definition of loss of income as stated on your policy terms and conditions.
Loss of Income
This is when You are unable to earn Your full Income for at least 30 (thirty) days, other than as a result of disability, for reasons that are beyond Your control, such as Retrenchment and No Work, No Pay. The inability to earn an Income because of the expiry of a fixed-term contract of Employment and in the case of a self-employed Policyholder, the failure by that Policyholder’s business to renew its contract(s), will not be covered.
- Income means the money earned monthly (or monthly equivalent where you are not paid monthly) from your Employment in the 3 (three) months before total Loss of Income..
Absa Life can therefore not accept liability for a claim.
