bad service

On the 19th of May 2021 at Durban my car was ******. I reported the matter same day on South African Police Services (ASPS) in Durban Central, the following day I reported to ABSA I – DIRECT insurance that my car was insured under. They told me that they would do their own investigation and revert within 10 working days. On the 9th on June someone who was handling my case from ABSA I – DIRECT insurance contacted me as they were in need of the tracking company that has installed a tracker in my vehicle. I gave them the details and the report of the tracking company that says they could not recover the car. On the 15th of June 2021 I received a message from the guy who is handling my case at ABSA I – DIRECT saying the car had been recovered by the Police it is in pounding site at Pretoria and there are forms he sent via emails that needed me to go to police station to commission it. The police officer told me that the form needed to be completed at the pounding site where the car was kept with all the details of the condition that the car was found in and after it had been identified by me as the owner. I received a call from the inspector from Pretoria telling me that they will not release the car from pounding site until I had gone to identify it. I asked the inspector about the condition of the car, he told me that the vin number, engine number, ignition and whole locking system had been tempered with, he advised that it would be best if the insurance would take the car to avoid getting in trouble as the car is marked as a cloned car by the SAPS and that the car insurance companies know that once the car has been cloned it is never going to be considered as new, it would need to be re-registered and it might give problems when I want to trade-in in the near future. I received a call from insurance agent telling me that they will bring the car to Durban for identification. On the 5th of July 2021 I received a call from an assessor telling me that I need to come and identify the car, I was surprised that the car was at a panel beater garage in Durban and not in police pounding site. The following day I went to the panel beater garage with the car assessor, to my surprise the panel beaters had already started working on the car for repairs even without me identifying it and it seemed as though it was something already discussed with the panel beaters that the car was there for repairs. I asked the assessor why it was brought to a panel beater and whether the investigating officer in Durban was informed of the recovery he could not answer. There was something on the side of the door that was removed and when I asked about it he told me that it was removed by the police as to show that the car has been cloned. I called my car insurance agent and informed him that I will not take the car back and that they should take it and settle the bank and sell the car for recovery of costs incurred. He told me that they will not pay the bank they will just fix the car and I will be issued with new documents. I told him that I bought a new car for a purpose and that I do not want to always be in fear wherever there is a road block that I might end up in jail for a cloned car. When I asked about the clearance from the police he could not provide any but told me that I should expect to pay R 3000.00 excess as they will repair the car. When I call the police officer in Durban, he told me that the car was not supposed to be in a panel beater it needs to be cleared first, that is not how things are done. Clearance need to be issued first after having assessed the car while in a pounding site and all that ABSA I-DIRECT is doing is not right procedure and also that it is ******* to fix the car without all due process is finished of which nothing has been finalized. To me the insurance agent IKSAAN MAHOMED ABID who is assisting me has a personal interest in all this, that is why he is forcing for the car to be fixed without following proper procedure. I mean everything has been tempered with I don’t know what else was done by them as some of the things my not be visible, I informed them that I won’t be taking it back.
