ABSA iDirect lame decline reasons

I had an accident on the 19th of May, logged claim with ABSA idirect on the 20th.

When the car was written off I was only informed verbally as to why they are declining no written document/quotes to show that it was not going to be economical to repair the car were given to me.

Below are details of complaint I have sent to their complaints division after receiving decline letter on the 16th os June:

I would like to lodge a dispute based on the attached letter.

"1. Absa idirect has known for over 2weeks already that the car has been written off however dragged the investigation with further assessments whilst I was kept in the dark most of the time I had to chase for feedback.-I will need as much time as well to seek legal advice on this matter, when I spoke to Andrew about 3 weeks ago he said the other driver was in Angola and he will need my tracking device details to check my whereabouts that evening, when my tracking device said they cannot assist with such information because the device I pay for is a beanie and they do not keep information on it only then he decided to appoint a tyre specialist which also took over a week to give feedback and I had to complain about the slowness of this assessment.

Why was the tyre specialist not appointed immediately with the initial assessor if it’s part of the process? this appears to me you were trying to find decline reasons every step of this process, tracking device could not be input to decline reason and then you had to drag the process and find another decline reason, I pay for insurance so I can be assisted during claim period in case of an accident not be sent from pillar to post whilst you seek decline reasons.

2. I have not been given detailed feedback on the misinterpretation/dishonesty referred to on this letter, Andrew stated witnesses claim that I was driving fast, how do you prove that a person was driving fast if the car did not even go beyond the robots, I have told him that if indeed I was driving fast then my car should have stopped way beyond were it stopped and it did not, the other car swinged the opposite direction perhaps mine could have done the same if indeed I was driving fast. I need full details on what this point means in relation to my claim.

3. On the phone he also said there is a claim I might have not told ABSA idirect about when I came on board, the sales person was not interested in old claims his questions clearly asked have you had an accident in the past 2years or so, you cannot use such information as a decline reason if this was not in recent years or within the period you state on your sales questions.

4. One of my tyres is new so if indeed tyres caused the accident why did the tyres not get a puncture? Up to what percentage do you determine that tyres were not in a good condition? if indeed it’s the tyres that cause the accident, then pay the other damages on the car and leave out the 3 tyres you have reported not to be in a good condition.

If the rejection is based on the tyres then why not apply depreciation on the claim based on those tyres instead of declining the entire claim? The car went for service recently and the tyres were not cited to be faulty.

5. I cannot accept these decline reasons and would like to hear your feedback shortly on my dispute, in addition to these the information you gave me below is wrong SMD cannot trace a car under that ref number you gave me, does that make you dishonest in this case as well? In the process of them not locating the right car who is liable for the storage fees you mentioned? I cannot be held liable for storage on matters of a claim being unnecessarily stalled, this decision should have been made shortly after the car was written off so I also have time to review and take suitable action, the letter you wrote me also has wrong dates does that make insurance company *********** and dishonest as well?

There was a day Andrew called and said he went to the scene and a day later expected me to go with him to the scene saying he cannot go there alone after having had said he has already been there, does this make him dishonest as well if he had already been there why did he need to go again with me and yet re-verifying address of a place he said he has been to?

I am not accepting the outcome of this claim and would like your complaints division as stated on the letter to look into this matter further."

I will be awaiting feedback on these and will take every route possible to make sure this is paid out, I pay insurance to be covered not to be frustrated at the time of need, accidents happen and insurance must be ready to assist their clients not take them from pillar to post trying to find decline reason(s), I have every intention of telling everyone who wants to do business with you that it's at their own risk as you go our of your way to find silly decline reasons I say this because a colleague of mine is going through the same issue with a decline from ABSA idirect because of a claim that was not even paid out by previous insurance. If tyres do really cause accidents and perhaps caused mine as you suggest, why do brand new cars with brand new tyres get involved in accidents as well?

If you had a tracking device or camera report stating the speed then I would believe the speed issue you are using against the claim as well on telephone conversations, the speed stated on my police report is correct, I never drove too fast on that road that day and if you cannot prove this you have no reason whatsoever to decline a claim on these basis.

I will be awaiting a response with facts on these claim because the current points I simply cannot accept there is no detail supporting them, if you run your business on a finding fault on your clients first then you might as well close shop cause no client want to be treated like these, this is utter robery.
