Entry refusal for not using store sanitiser

On Saturday 24 July 2021 my wife and I went to the Identity store in Mooirivier Mall Potchefstroom. On arrival we sanitised our hands with our own (sensitive) hand sanitiser, which we always carry with us and use at every store. We were immediately stopped by the store security and entry to the store was refused, if we do not use the store's provided sanitiser.

We explained that we had sanitised our hands, using our own sanitiser, and the security admitted that she could smell that it was indeed sanitiser, but she said: "our policy states that YOU MUST make use of our sanitiser if you want to enter the store".

We called the manager to find out about this absurd policy statement, upon which she had no comment, but also refused us entry. We immediately asked for the store's SOP on which she would not provide it and said that we should find it online or enquire it using the call centre's number. It was also absurd to note that, during this encounter, not the manager or the security guard were wearing their masks properly, as stated by law.

The manager of the store then called the centre/mall security to remove us from, not just from the store, but the premises event hough we did not do anything wrong.

We wish to advise that the strict protocols implemented by Identity are following all the relevant legislation and guidelines as issued by Government. The Regulations and Directions require us to provide hand sanitizer with a 70% alcohol content for the use of customers and staff entering our stores. As we cannot ensure that a customer’s sanitizer meets this requirement, we require all customers to use our in-store sanitizers as we have the relevant documentation from our approved suppliers, which confirms that it meets such requirements. 

Identity has ensured its strict adherence to these requirements and implemented extensive protocols that ensure the safety of both our customers and staff when in our stores. We, therefore, confirm that you were correctly advised the day of your visit. However, we wish to apologize for how you felt the Management attended to you on the day and hope that we can meet or exceed your expectations on your next visit.

On request for the MSDS of the sanitiser that is used in store, the manager wasn't able to supply it. So if I'm allergic to any substance in the sanitiser and I'm FORCED to use it, will you be happy if I take legal actions? It comes down to **************.
