UNFAIR AND UNJUST TREATMENT FROM HYUNDAI SPRINGS FROM BOTH SALES PERSON AND MANAGER

We Purchased a company vehicle from Hyundai Springs branch on the 24th of May 2022 The Vehicle description is : h100 Hundai Sales Person : Suhail Chotia Manager : Abdul Samad Rahman

The day we came to collect the vehicle, was the 24th of May 2022. Suhail told us that we can collect the vehicle and they will then send the number plate within a month. The invoiced amount for License and registration was R2500. After numerous communications, the dealer then decided that we should go ahead with the licence and registration process and they will reimburse us the amounts.

We then went on and we did the process on their behalf, which is something they had failed to do. This was already charged on our invoice, issued to us. The day we went to the apply we were surprisely charged a fine of R205.40 which was the debt accumulated due to late licensing of the vehicle, because Hyundai Springs failed to license this for us on time hence the debt. This was communicated to the sales consultant, via email. Yet, he insisted on paying us R828.00 in total, which we fail to understand because the invoice amounted R2500. Reasons for making a R828 payment; was that they needed proof to show how much we had paid, but we told them that we did not keep any receipt as this was never requested for in the first place and neither was it discussed that they will need all POP. the agreement was that, we should go and register the vehicle and they will compensate us. It was never our duty to fulfil this process, yet we obliged in spite of it being understood that it was their duty to fulfil this.

We then tried to call the Sales person to try find an amicable solution to this as we found the payment made to us did not correspond with the total amount invoiced. He then directed us to his Manager, Mr Abdul Samad Rahman.

I tried to make Mr Abdul understand that, this was an issue that they created, a mess they made which also even lead us to being fined for late registration. My question then remains, who is going to compensate us for this? Mr Abdul told me that he won’t be able to pay me as it was agreed that they will pay us on proven cost, I then corrected him with that statement, the day this was discussed, there was no mention of proven costs, only that they will compensate us.

Furthermore, during our discussions with Mr Abdul I highlighted to him that, if he and I are not in agreement common law should prevail. In this regard they should just compensate us the full invoiced amount of R2500 as this is the only formulated figure we have and the R828.00 was never part of any discussion. The question remains, as to how they broke down to the amount of R828.00 from the R2500 invoiced.

Remember, this is a contractual obligation they failed to adhere to and we never wanted to do this. Unfortunately the Manager was extremely rude and he profusely told me that he will not pay us any money as we did not deserve the R2500 but the amount he sent, of R828.00.

I find the managers conduct unfair and ********, this is an unjust enrichment from the Hyundai Springs branch and we feel violated and disrespected by the Managers conduct.

If this is what Hyundai modus operandi, I suggested they need to inform us if this is the case. How they train their managers to ********ly treat its customers as well as ********ly and unjustly enrich themselves.

I am disappointed with the conduct from Hyundai, as I expected the process to be fair. Additionally so the delayed conduct from the Sales person who never made efforts to have this resolved and his involvement in this process. Has made zero efforts to resolve this. Even worse he did not seem like somebody who knew exactly what he was doing as he would just refer us to his manager. With everything that he did.

My greatest disappointment lies also with Mr Abdul as his conduct was very unprofessional and brash. More so his argument made no sense as to why he did not want to pay us the full amount as this was something that should have been done by them and not us, they failed to meet their contractual obligation and that was from an invoiced amount of R2500, which they had billed us. Then why pay us only R828.00

If the gentlemen in question understood their contractual obligations they would understand the process of License and registration towards the vehical we purchased on the 24th May 2022, registered on the 18th of July 2022. For people who I assume have been in the industry for long, we expect them to understand that there would be some sort of penalty imposed due to the time taken to register the vehicle.

In Summary:

• This complaint may seem a bit exaggerated for the seemingly insignificant amount of R1672 which is what is outstanding from the invoiced R2500, but I would like to highlight the fact that, why would they need to reimburse us the R828.00 if, as they have stated there is no POP/Invoices and therefore no basis for full reimbur*****t.

• For me this is not about the money, but the unfair conduct , unprofessionalism and moreover a very impressionable and long lasting reservation to future business with the Hyundai group/franchise, and more so to highlight to other parties wanting to do business with Hyundai, that this is the kind of service they should expect.
