Violation of consumer rights

I Florence purchased a cellphone Huawei GR3 2016 from a well known retail store on the 29/11/2019 (black friday) on the 03/12/2019 went back to the store with the phone which was not switching anymore, i was told they will book the phone for repair since it was OBF and Huawei was no longer sending the phone to they store so there was no other phone to replace mine with than booking it as a repair. I understood the consultant at the store and my phone was booked and accepted at the repair centre, days later I was informed that the phone was out of warranty and my phone was returned to me unfixed i have been informed by email that Huawei is reacting to fix my phone. That phone was out of warranty when it was sold to me. Is that my fault that the was 3yrs at the store before it was sold to me?

I want to know how is it possible that a phone purchased on that day and before 7 days it wss returned back to the store and that phone is deemed out of warranty.?
