Breech of contract from Telkom and Huawei

<p>I signed a contract for a Huawei P9 on the 29 January 2017 after much convincing from Thabo at Walmer Park, Port Elizabeth Telkom. They told me it was a fantastic deal and the phone was brilliant and no-one has ever had a problem with it. I have always used a Samsung. He told me the bonus was that you get a Tablet with the phone when signing up and a free gift which would be available next week. He did explain that the tablet was for the first 1000 customers, but they had just lunched the special and I was one of the 1st. I agreed to the contract as the Tablet was for my daughter’s birthday. I went in weekly and they said that they were still waiting for the tablets and would call me as soon as they arrived. The one sales consultant even phoned to check if any other branch had one for me. I went in again on the 5 March to be told unfortunately that there are no tablets available and no-one is receiving. I did inform them that that is breach of contract and I signed a contract on the guarantee that a tablet was part of the package which was confirmed on the day by Thabo. Unfortunately Thabo had left they said. Unacceptable! Who is now accountable?</p> <p> I then sent the Regional Manager of Huawei, Andre Du Plessis an email explaining the above. The below was his response</p> <p>"We did have a bundle deal with the P9 however this was while stocks last and these tablets were packaged together and weren’t sent separately."</p> <p>My response was the following</p> <p>The contract was sold to me with the GUARENTEE of the tablet. It is breach of contract which I will not accept. I bought the Huawei P9 as well as the Tablet which has not been delivered. I honestly cannot believe as the Regional Manager of Huawei you send the below email with no acceptance of your staffs actions. On numerous occasions Thabo said that it was still to be delivered when I went in and that they would be in contact with me once it was. If it was while stocks last why was I not informed on the say I signed the contract? They clearly stated that I was one of the first customers to sign. Your staff are poorly trained at ground level and are a bad reflection on your brand.</p> <p> </p> <p>Please can you forward me your superiors number and I will be getting in contact with Senior Management of Telkom Mobile. It drives us to behave honestly and keep our promises, ultimately winning our customers’ trust and respect. </p> <p> </p> <p>As mentioned I will be in contact with Senior Management of Huawei and Telkom. Just about every core principle has not been delivered as promised.</p> <p> </p> <p>To date I have never had a follow up call or a email from Huawei or Telkom.
