WANTING TO COLLECT MONEY ON PRESCRIBED DEBT

I had an account with Bruma in 2013. Due to unforeseen circumstances I was unable to pay this account. Judging from HTN's statement, this account was sold to them in 2014. I have claimed prescription on these accounts. I had then app**** for a homeloan which was declined. Upon pulling out new reports, it was the Bruma accounts. When I tried explaining to them that prescription doesnt apply from the date the account was sold they didnt seem to understand.

I then received this email

QUOTE :

Good day *****

Your Bruma Finance account has been handed over to HTN Attorneys. We have attempted to contact you on several occasions with no success. According to our records, your account is overdue and there is no active payment or arrangement with HTN Attorneys.

It is crucial that a valid payment arrangement is made on your account as soon as possible, not only to avoid fees and additional interest, but also to avoid legal proceedings.

Contact us on ***(select Option 1) or *** to make payment arrangements.

BUREAU LISTING NOTICE ITO SECTION 72 OF THE NCA:

Should you continue to remain in default, you need to know that your payment history could be submitted to the credit bureaus within 20 (twenty) days from date hereof. As a result, adverse payment information could reflect on your credit profile, which could affect your credit score and your ability to obtain credit. All Credit Providers do credit checks. Paying your debt on time may improve your credit rating.

Regards,

Sandisiwe Mbengashe

According to the “The National Credit Amendment Act, published 13 March 2015, it prohibits the sale and collection of Prescribed Debt”. Please note that I find myself in a terrible predicament because of this. Should this not be cleared / closed, i am then liable for estate agent penalties, etc.

Please also be advised that I have not ackwoledged any account in the last 3 years and I do not intend on doing so. So please stop calling me for payment - rather sort out this issue.
