A year later, still no joy...

I first submitted my complaint about a medical practitioner to the HPCSA over a year ago in the form of a registered letter with all applicable documents. I recieved an email confirming receipt of my complaint, and that they have referred to David Koleng for investigation.

Six months later I called their office which was followed up by an email from Magadiela Solekhaya asking me to submit my complaint in English (my initial correspondence was in my first language of Afrikaans). I sent her the translated complaint, and the response was that the doctor/s had 40 days to respond.

On 7 December I enquired again and the response said they are still waiting for the doctor's explanation, and if a response wasn't forthcoming further charges would be added.

On 11 January I sent another email to Solekhaya - no response. On 7 March i sent another email, still no response... 15 March I called their office and spoke to Elsabie, who said she will go and hand this all to David, and ask him to call me. No response.....

14 March I called Elsabie again, she said she didn't know what was going on, because this case should have been reviewed and she gave me another email address for Shainaaz, which I forwarded all the correspondence to. No response....

19 April I called again, spoke to Palesa Mohoto, she said she would forward the case to Solekhaya. No response....

29 April I sent another email to Palesa.... response was that she had forwarded the case to Solekhaya and Shainaaz. Still... no response.

What I would like to know is what is the function of the HPCSA? Are they here to serve the public, or are they simply obstructing us from recieving recourse from medical malfeasance?

I would like to put this matter behind me, for once and for all, so some kind of resolution (or useful response) would be greatly appreciated.

Christo Grobbelaar

Morning Sir

Firstly please accept our apologies for lack of feedback or response, moving forward you can always mail me and I will furnish you with feedback, we have been investigating your matter . The respondent is not co-operating as we have send several letters and made calls to the doctor with no success, we are now going to trace the doctor so that either we send someone to personally serve the doctor.

If all has failed we will then place it for consideration and will inform the committee that we have exhausted all avenues to notify the doctor, and a further charge will be added against the doctor as it is an offense not to respond to our correspondence.

Once apologies for what has happened

Regards

David Kokong

I rep****;

Good day David,

Thank you for your response and further information.

As the contract is in Afrikaans, I would like clarify that I sought legal advice and was told that the contract is not valid due to the following:

- the contract stipulates that it can only be used for residential purposes
- its ******* to incorporate / combine contracts (the [unsigned] business section of this contract was added after I signed the residential section)

I hope you are able to get some kind of response from the doctor/s concerned, and I would be grateful if you would keep me apprised of any developments in this regard.

Yours sincerely,

Christo Grobbelaar
