Selling out of warranty items as new

Still waiting for House and Home to replace my vacuum. They say I have physically abused the vacuum. To run it without filters. I only used it to vacuum tile floor twice a week for less then 2 months. When I took it back because it didnt want to power on. I took it just like it. Even with the dirt in the brown paper bag. The lady at house and home told me that the machine dint even looked use even all the pipe attachechments was still in there plastic bags. Even the boxs with all the wrappers was retuned. Now they say I mis used the machine without filters because the filters is not there. On a second occasion they told me the filter was there but was incorrect. They send me a photo of the filter but if your clued up with vehicle spares you can see its a vehicle airfilter they sended me. Then i got hold of the manufacturers paper works which shows the machines warranty expired 6 months before I bought the machine. They cant explain it to me. They just tell me I mis used the machine.
