****************!

I purchased an Hp notebook from House & Home in Eastgete. In the first instance, the sales consultant, Marvelous, failed to explain the fact that a 7 day returns policy would be applicable. I then experienced problems with the notebook, wherein it was refusing to read my modem. I went to the store on 8 October and met the store manager Elize, and explained the issue to her. Even SHE failed to explain the fact that the report of the matter was beyond the so-called 7-day period. She advised that the matter would be communicated to the supplier, and would be taken up with them on Monday, since they do not operate on weekends. A few days later, the complaints consultant (Marcia) contacted me, I explained the issue to her and she advised that she would take the matter up with the supplier. I then received a call from Apporva, who said that she is a representative from Hp. I explained the issue to her and she advised that it might be a software issue and that she would e-mail links to me for to update the software. Indeed, she e-mailed the links. I updated the software using the links, according to her instruction, however I continued experiencing the same issue. I then decided to take the laptop back to the store and request an exchange or a refund. I met with the complaints consultant, Marcia, and CharlotteWetlhagen, who said that they would discuss the matter with the branch manager, Elize and that the notebook would have to be taken to the supplier for assessment, a process that would take 21 DAYS. In her (Elize) response to me she stated that the issue was communicated after the 7-day period had expired and that the laptop would need to be taken to Hp for an assessment. I do not have and CANNOT afford to wait for 21 DAYS at MY inconvenience, when in fact I purchased a BRAND NEW laptop which is reasonably expected to operate in the manner in which items of a similar nature and age should be expected to operate. Section 19(5)(a) states the following: "When a supplier tenders delivery to a consumer of any goods, the supplier must,on request, allow the consumer a reasonable opportunity to examine those goods for the purpose of ascertaining whether the consumer is satisfied that the goods are of a type and quality reasonably contemplated in the agreement". Furthermore, section 20(2)(b) states the following: "the consumer may return goods to the supplier, and receive a full refund of any consideration paid for those goods, if the supplier has delivered goods that the consumer did not have an opportunity to examine before delivery". The fact that the branch manager, Elize, is refusing to hear my matter accordingly, is a clear violation of my rights as a consumer.

To make matters worse, I had to call her more than 10 times in order to get hold of her and receive clarity regarding the matter. The staff members even went to the extent of avoiding my phone calls. This is an indication of UNPROFESSIONALISM and arrogance in dealing with the matter speedily.

My rights as a consumer have been violated and this is a clear case of ****************!
