Breach of contract, failure to adhere to promises
I bought a cell phone from House & Home in Alberton, I was forced to take all risk insurance and I was told that it is compulsory, which I think is unfair because the customer must be given a choice of what suite their pocket.
Anyway, the phone went missing after a year and Shoprite insurance, according to the insurance that they forced me to take under duress, had an obligation to replace my phone as it was covered by their insurance, my phone was worth R2299.00 and Shoprite insurance is replacing me with the phone that is worth R899, which I think is a day light rip-off. On their contractual terms and conditions, they mentioned that in the event that anything happen to the phone, they will replace it and if the same model is discontinued, they will replace it with a phone of the same value or more. I fail to understand why I must take a phone that is far cheaper as a replacement because that is a breach of the contract and I believe that the Shoprite insurance wants to make profit out of me and save money by giving me a cheap phone which is not the value of the phone that I have insured.
I will like to bring this to attention of a senior who will help or I will escalate
