Honda Midrand - Not refunding deposit
I was interested in purchasing a new vehicle at Honda Midrand and was asked to pay a deposit to hold the vehicle for me. Due to concerns about affordability, I changed my mind and decided not to buy the vehicle. Honda Midrand refused to refund my deposit, saying that they incurred costs ordering the vehicle. However, no documentation/contract was signed by me whatsoever, and all communication was either telephonic or via email. I would also like to add that no Terms and Conditions were made available to me at all before or after I paid this deposit...neither verbally nor in writing. I would like Honda Midrand to explain this because according to me, it goes against the principles of the CPA. Is it normal practice for Honda to not refund deposits even when no contract was entered into in writing? If so, why is this the case, and how is this in line with the Consumer Protection Act? I already explained the problem to the Dealer Principle (Eric Calverley) at Honda Midrand and Yvette Tshambo at Honda Care, yet I just received poor subjective feedback, and my Deposit was not refunded. I am taking this up with the Motor Industry Ombudsman, but I want formal feedback from Honda as well.
