Homely Property not completing property build on 50% finnished and have been paid full contract price by their attorneys
Good day I entered into a building Contract with Homely Property 65 Wedgewood Golf & Country Estate, Port Elizabeth on 1 October 2021. Building work commenced last year. The home was meant to be completed by 1 March 2023. However, the house is only 48 - 50% complete, their attorneys have given them the full contract price, and they keep making excuses for commencing with the build. Initially I received photographs on the build every 2 weeks and then it stopped. I am very concerned as they have received the progress payment and the work is not carrying on. Please help in our taking Home Property to task. Regards

20 Jun 2023, 13:48WITHOUT PREJUDICE: Hello everyone. We have accommodated Mrs. Dade to the best of our ability. Initially there was a shortfall in her funds of R210,000 which we waited for for some time, and hence the first delay. We then agreed to use her original deposit to continue so we would not waste time. Secondly, there was a delay in the payment by Mrs. Dade of R13,000 as she wanted alternative tiles - another delay. We then stood in for her so we could continue. There was a further delay by Mrs. Dade because of a shortfall of R25,000 due for soil drains that needed to be constructed. We again stood in for her on this. Both her R13,000 and the R25,000 which were due in March 2023 are still outstanding. We nevertheless are well within our construction build period, and we are certain this will all end very well for everyone. We hope she will enjoy her investment once we are finished.

20 Jun 2023, 15:00Good day, Further to Homely Property's response, no further funds were paid because they are behind on the build. They were paid the amount of R1 174 970.64 on 18th January 2023 to complete the build, as per the contract and the Progress payment sheet that was presented to their Attorneys for the build. However, work stopped, our e-mails were ignored by all concerned. When we did receive a response there were always delays with no pictures as promised or list of items completed. Initially we received pictures every week and then every 2 weeks, and then things went quiet in March. We were very concerned with work stopping as this amount that they were paid could have accrued interest in our investment account for the shortfalls due by us. Homely Property only put the roof on in April and Window and Door frames were only installed last week 14 June 2023. Additional amounts as called for were paid to their Attorneys on 10th February 2023, so we are not really behind with payments for anything expect the tiles and the Septic Tank in terms of the Variation Agreement. We wanted work to proceed with all work being done in terms of the draws taken, before any further payments were made. Thankfully this is now happening. I do hope that this will be a situation where I can report I am a happy client with the investment I have made with Homely Property, as you can imagine this is exciting as it is our Retirement Investment.
