I am compelled to express my profound consternation regarding a series of unbidden telephonic solicitations I have received from your organization. Despite my assiduous endeavors to safeguard my personal contact information and ensure its utilization is confined to indispensable communications, I have been subjected to an incessant barrage of unwelcome calls originating from your company. These unsolicited communications have precipitated considerable perturbation and inconvenience.

In the first instance, it is imperative to underscore that I have not, at any juncture, proffered explicit consent for your organization to contact me telephonically. As a meticulous custodian of my personal data, I am scrupulous about its dissemination and usage. The fact that I am receiving these calls implies a transgression of privacy or dereliction in your company’s compliance with data protection statutes.

The telephonic solicitations I have endured are not only recurrent but also transpire at inopportune times, thereby amplifying the disruption to my quotidian existence. Despite my reiterated entreaties to your representatives to desist from these communications, the calls have persisted unabated and in unreasonable large volume. This flagrant disregard for my articulated preferences is both unprofessional and intolerable.

I hereby solicit the following remedial actions forthwith:

Cessation of Unsolicited Communications: Expunge my telephone number from your calling lists posthaste and ensure no further unsolicited telephonic communications are directed towards me. Elucidation of Data Acquisition: Furnish a comprehensive elucidation of the provenance of my contact information. This should encompass the source, method of acquisition, and any consent records purportedly held. Compliance Assurance: Provide written affirmation of your company’s adherence to all relevant data protection and privacy statutes, delineating the measures you will implement to forestall a recurrence of this predicament for other consumers. Furthermore, I anticipate a prompt and exhaustive response to this complaint within a fortnight. Should my concerns remain unaddressed satisfactorily, I shall be compelled to escalate this matter to the appropriate regulatory authorities. I trust you will accord this complaint the gravity it merits and take immediate action to rectify the situation. Unsolicited communications constitute a significant violation of privacy, and I expect your organization to uphold the requisite standards of respect and compliance in the contemporary consumer milieu.

I regret to inform you that I am currently unable to ascertain the nature of the phone calls in question, as my professional obligations preclude me from answering them during work hours. When circumstances do permit me to respond, the operator typically terminates the call prematurely. Thus far, I have been subjected to six such calls today. Consequently, I must meticulously cross-reference each incoming number against the Truecaller application to discern whether it is indeed HomeChoice or a matter of greater significance. This laborious process consumes a considerable portion of my daily schedule.

Despite my repeated entreaties to have my number expunged from your contact lists, conveyed via multiple channels (email, phone, and Hellopeter), these unsolicited communications persist unabated. Regrettably, I find myself compelled to implement the following stipulation: henceforth, any further telephonic communication from homechoice (Pty) Ltd or any of its representatives will incur a charge of R150 per instance.

This stipulation shall be effectuated immediately upon the dispatch of this email. Any subsequent telephonic communication from homechoice (Pty) Ltd or its representatives will be construed as tacit acceptance of these terms.

Thank you for your message. Regrettably, I cannot acquiesce to the 48-hour waiting period, as I have been petitioning for several months for the removal of my number from your systems. You may refer to your call recordings for corroborative evidence of these occurrences.

Pursuant to my stipulation on Friday, the terms were deemed accepted on Saturday morning at 10:24 AM when I received the first call of the day from the number ***. I was also contacted at the following times.

10:36 am - ***
11:38 am - ***
12:11 am - ***

I was then contacted again on Sunday at the following times.

09:16 am - ***
09:39 am - ***
10:29 am - ***
11:29 am - ***
11:42 am - ***
1:59 pm - ***

As you can undoubtedly discern, this pattern of calls transcends mere marketing and unequivocally constitutes harassment. It is implausible to consider these occurrences as accidental; they are clearly deliberate and seemingly executed with malice.

In light of this persistent issue, I must amend my previous stipulation to include an enhanced charge for after-hours contact (beyond business hours and weekends), which will henceforth be R250 per instance.

Kindly provide the contact details for your finance department to which I can forward the invoice for the R1500 contact charge incurred (four calls on Saturday and six calls on Sunday at R150 per call).
