Refusing to close off a 13 year old prescribed account

Dear Sir/Madam,

I am writing to formally raise a complaint regarding the above-mentioned account, which has been incorrectly kept active despite being prescribed.

My last payment on this account was made in 2013, and we are now in 2026, meaning that 13 years have passed with no payment, no acknowledgement of debt, and no contact from my side. Based on this, the account has clearly prescribed in terms of the National Credit Act, which provides for a 3-year prescription period under normal circumstances.

Despite this, I have made multiple attempts to have this matter resolved and the account closed, but this has not been actioned. This ongoing failure to correct your records is unacceptable and is causing unnecessary stress and prejudice against me.

I would like to make the following absolutely clear: • This debt is legally prescribed and is therefore no longer enforceable. • Any continued attempt to hold me liable or keep this account active is improper and ******** conduct. • Your failure to resolve this issue despite prior requests is unacceptable and reflects poorly on your internal processes and compliance.

I require the following actions to be taken immediately: 1. The closure of this account with immediate effect 2. Written confirmation that the account has been marked as prescribed and settled 3. Removal of any adverse or incorrect listing related to this account from all credit bureaus

Should this matter not be resolved within 5 working days, I will have no hesitation in escalating this complaint to the National Financial Ombud Scheme and the National Credit Regulator for formal investigation and intervention.

This email serves as a final attempt to resolve this matter directly with you before formal escalation.

I expect urgent attention and written confirmation of resolution. Imagine being told a 13 year old account is handed over. Your generic responses are not helping me in anyway
