Two Repairs in 3 Months – Still No Working Breville Coffee Machine

purchased a Breville coffee machine on 21 May 2024. It failed in April 2025, was sent for repair, and returned to me on 2 May 2025. The same defect reoccurred in July 2025 (***). Despite my complaint lodged on 6 August 2025, I have received only holding calls from stores and no substantive response. The machine remains unusable. In terms of Section 56(3) of the Consumer Protection Act, where a failure recurs within three months of a repair, a consumer is entitled to elect either a replacement or a refund. This interpretation has been consistently upheld in determinations by the Consumer Goods and Services Ombud. Instead of resolving the matter, I have been left without a working product, forced to follow up repeatedly, and have experienced delays with no accountability. Facts: Product purchased: 21 May 2024 First failure: April 2025 Repair completed: 2 May 2025 Repeat failure: July 2025 (***) Complaint logged: 6 August 2025 – still unresolved This is a clear breach of consumer rights. I now formally demand either a new replacement unit or a full refund, failing which I will escalate to the Consumer Goods and Services Ombud for enforcement.
