Getting back my deposit

I was renting in one of Hilbert construction in Meyerton, Protea gardens unit number 9. I paid full deposit and rental money which was R12000 in total (R5400 deposit, R5400 rental, R500 key deposit and R700 admin fee. I served my notice month and informed Ryno that I will be moving out. He told me that he won't give me my deposit because the unit will be empty and he will not be making money. After few days he called me and told me that he will deduct a certain percentage from my deposit and when I asked the reason for the deduction he said is from the contract. When I moved in he promised to draft my lease agreement but he could not deliver. I had no contract and made attempts for him to bring it but he failed to do so. I went to the police to get assistant, Ryno told the police that I vandalised his property. I left the keys with a friend staying in the complex and that was the agreement between the both of us to live the keys with a friend. I have pictures of the place proving that the place is still in good condition. I dont have a place to stay because I can not afford to pay rental and deposit unless I get my deposit back from Hilbert constructions.
