Developer insists on the purchaser to pay occupational rent as per agreement..
Please assist in referring my dissatisfaction with the developer for the way in which a specific clause is being implemented. The details are as follows.: I entered into sale agreement to purchase an apartment off plan 3 yrs. ago. One of the clauses stated the occupational rent is to be paid on taking occupation. I have now taken occupation and paid occupational rent but the transfer of the property to my name is yet to be lodged because the developer through its lawyers is waiting for certain documents. The agreement did not stipulate for how long I will have to pau occupational rent. The implication is that as long as the transfer is not done, occupational rent is mandatory as per agreement and judging by the delay this could be anything from 3 - 6 months. The financial implication of this clause was never anticipated even I agree I signed. As such, the developer/lawyers do not want to give any timeline of when the transfer will happen but insist that the occupational rent has to be paid. This seems very prejudicial and only advantaging the developer, which independent body is best suited to address this unfair practice without resorting to lawyers.
