HAVAL MUST FALL, FAST!

I bought a HAVAL H2 in December 2019. On 14 September 2021 we travelled with the car from Bloemfontein to PE. About 20 km outside Cradock the clutch burned and the car could not get into gear. I contacted the 24hr Road side Assistance and they were very helpful. They sent a tow truck and the car was towed to Queenstown (which was the nearest Dealership from where the 'breakdown' occurred. Fast forward 5 weeks later - the car is still in QT and has not been repaired. The reason: HAVAL refused to pay the repair costs (R16800) because they claim the service was nine months late. The service was not late. In the Haval Warranty Book it states the service intervals as: 15000km or annually. I was going to take the car to be serviced at 15000km (as did many other customers). The clutch burned when the car's mileage was almost 14000km. Haval's argument is that the customers should know that you should service the car at 'whichever comes first'. My argument is that if it is not written whichever comes first (the mileage or the time) then the customer has a choice. This is how other HAVAL customers I know off understand the clause. If it was clearly stated 'whichever comes first" I would have taken it for the annual service. Also, I took the car in July 2020 for the kilos to be set at the HAVAL dealership in Bloemfontein. At that time the car was at 5000km. I was told that the 1st service is due at 15000km. I was also told by the service advisor that I can take it in at 15000km OR annually. Many customers took in their cars to be serviced at 15000km and were not told they were late. Haval's argument is that you cannot drive a car for almost two years and not service it. My argument is that I did nothing wrong. The kilos on the car are very low, I drive little, but my most compelling argument is that they give us an option, so whichever option I choose cannot be punishable. Now they want to cancel my 5 year/100000km warranty also because I skipped a service - according to them. Or they are considering making it 50%. Which means if the car breaks, they will only cover 50% of the repair costs. I'll have to fork up 50%. They also claim they're not paying for the clutch because the clutch is a wear and tear item. I accept that. But the item is covered for a warranty of 1 year/20000km. Haval now says the car is older than a year. Which it is. But it has not reached the 20000km mileage. The Customer Care lady did tell me the clutch is a wear and tear item, but I though they would pay because the car has far less than 20000km. People asked me when I bought a car that was made in China if it was a good move. At the time it was. It's a beautiful car. It was affordable but still, it was made in China. I had no problem with the car for about 20 months, until the clutch burned. I have been driving for more than 20 years. And my style/way of driving has been consistent. I've had five cars before this one. None of them ever had a clutch that burned, especially not at 14000km. Why would this happen to a car that was made in China. Is it not possible that it's a factor defect. Because when I asked the lady at Customer Care what exactly caused the clutch to burn I was not given a straight answer. I was told wear and tear can be caused by several things. I want to know which of the several possible things caused MY car's clutch to burn. They refuse to show me the assessment report. Lastly, the people at Haval Head Office were not helpful nor empathetic at all. I will not say much about the poor service and their disregard for their customers. I will NEVER buy a car again that was made in China.
