Collecting Money and then not delivering on their promises
This email serves to notify you of my intention to proceed with legal action against your Company.
After receiving your emails regarding a training course for Construction Estimating and Tendering I advise that I want to send my son from Zambia based on the fact that the training will proceed and I will be able to obtain flight tickets out of Zambia for him to attend the said course. This was based on email send to your offices on the 14 June 2018 at 07:31.
On 14 June 2018 at 11:47 I send an email with a preliminary booking based on the conditions of the training going ahead and me obtaining air tickets for my son to fly out to attend the training course based on your email received at 07:39 stipulating the following Quote” Dear Franques, yes it is going ahead. we actually left with space for 3 delegates, kindly send in your registration form soonest, kind Regards, ***X” end of quote.
On 18 June 2018 at 08:57 I received an email with an amended invoice from yourself requesting payment and sending through the proof of payment on the same day at 10:44 the requested payment for R8999.00 (Eight Thousand Nine Hundred and Ninety Nine Rand) were transferred into the stipulated account on the application form.
On the 18th of June 2018 at 14:22 I have send you an email requesting confirmation that the money was received by your offices but had no response at all. On 19th of June I forwarded another email requesting feedback on the same matter and again I had no response. I then called your office numbers and after making numerous calls I ended up talking to you in person. Again I asked explicitly if the course is going to happen as the tickets are booked, a car rented and accommodation sorted, you confirmed that the course will go ahead.
On 19 June at 14:28 I received an email from ********** informing me of the moving of the training course to 12 and 13 July 2018. I notified you immediately that this does not suite me as I have incurred costs already to fly the person out to attend the training course and your response was The arrangements you have made can be rescheduled sir, if you have incurred cost, we are willing to look into them. Events as indicated in our terms and conditions can be reschedule due to circumstances beyond our control. This after I clearly explained to you that I am sending him from Zambia prior to arranging flights and accommodation.
Since then I have not heard from your offices and I extended his stay so that he can attend the course on the 12 and 13th of July as indicated.
Today the 09th of July I had to enquire again regarding the course just to hear that the course has been rescheduled again. This arrangements does not suite me anymore and the costs I will have to incur to send him out again does not justify it at all and it is not convenient anymore. The flights alone are in Excess of R8000.00 return.
Therefore I hereby request that you refund my money, with interest, within 3 (Three days) from receipt of this email. By the trail of events it is clear that ***X was aware that the course will not take place and hence insisted that I pay the amount into your bank account, which I personally think is and was ********** to do.
I am sure we can resolve this issue amicably without this having to go to the small claims court or even involving lawyers for that matter.
