Don't WAIVER Your Consumer Rights

Beware when using Happy Pay. You WAIVER your consumer rights as they are not governed by the National Consumer Act.

Your claims are misleading and hold no merit.

On 26/07/2024, you used our platform to purchase a new iPhone 7 32GB and a new iPhone 7 128GB — both delivered to you in full. Despite this, you failed to make any payments for over a year. After numerous contact attempts and eventual handover to collections, only now has a payment been made.

It is both disappointing and unacceptable that, as someone who deliberately ignored your financial obligation, you now attempt to discredit the same provider that enabled your purchase when no other service would.

Your public complaint is not only unfounded — it conveniently ignores the fact that you received the benefit of the goods without honouring your side of the agreement.

To be clear: BNPL providers like us are exempt from the National Credit Act (NCA) due to the interest-free nature of our offering. However, this does not absolve consumers from paying for goods received, nor does it entitle anyone to publicly defame a business for enforcing the terms of an agreement you accepted.

We strongly encourage you to take accountability before posting inaccurate and damaging statements.

Oh so because you guys are exempt it gives you the right to threaten a consumer with "the police" for not paying?

Freedom of speech and expression is my rights, and that is why platforms like this exist. Would you like me to share the emails you sent me where you guys threatened me with the police?

There is no law against not paying outstanding credit, but there is a law against threatening a consumer with ******** conviction of ***** or theft for not repaying.

The NCA clearly states the following:

Proper Debt Collection Process: Legitimate debt collectors in South Africa must follow the National Credit Act (NCA) and Debt Collectors Act, which include:
  • Providing proper notice and statements
  • Following prescribed collection procedures
  • Obtaining court judgments before taking enforcement action
  • Using registered debt collectors

You guys can be lucky I can't post a screenshot of your email on Hellopeter, as you followed none of these as you guys are "exempt" so you can take advantage of me as a consumer.
