Unhappy with school and refund refused

I enrolled my child in the school and paid R1650 DEP and FEE after 2 days I picked up that my child was bitterly unhappy and he had picked up lice and the flu. I emailed the owner Stacey that I was unhappy and insisted upon a refund less the deposit and the 2 days of attendance. She said she would sort it out that Monday making me believe that she would be reasonable and refund me.<br> <br> The following monday came and went I did not hear from her as promised after 3 weeks of following up and being kept on a string she finally tells me that she will not refund me. Aparently the decision was made by the non exsistent other directors.<br> <br> I feel that my consumer rights have been violated as I have a right to change my mind about a school for the safety of my child but that does not give Stacey the right to keep all my money.<br> <br> I have the RIGHT TO CHOOSE my PRODUCT b) Right to renew or cancel an agreement: Suppliers may charge reasonable penalties on cancellations.<br> f) RIGHT TO CANCEL DIRECT MARKETING CONTRACTS WITHIN THE COOLING-OFF PERIOD - You are entitled to cancel agreements within the prescribed cooling-off period without incurring penalties or providing reasons for your decision.

In response to the above matter, we the owners of Happy Days Child Care Centres cc would like to advise as follows:

1. We were not informed or shown that this lady’s child had lice. After this spurious accusation ALL the children (there were only around 10 children on site as schools had not yet re-opened) were checked for lice and ALL were negative.

2. This lady first said they were moving (which according to our information they have NOT). Then she came with the lice story which once again we can PROVE was a lie as not ONE other child had anything close to lice and ALL were minutely checked.

3. We were the first multi-racial centre in Kempton Park (since 1987) and as a consequence still have a overwhelming majority of black children, which we believe was the real problem. I, as the founder of Happy Days, do not tolerate ****** and she is denying her child a golden opportunity to interact from young with children from the majority races in our country, in a high quality centre..

4. I was the sole member until 5 years ago when I suffered a major heart attack and my 4 children were each given 25% of the business. There are 4 directors and myself as company Chairman (no longer a shareholder) so the accusation that my youngest daughter (Stacey) is the sole member is incorrect and libellous.

5. Stacey as CEO was hijacked and her phone and bag ****** ( we have a case number to prove this), This lady only attempted to contact her via her cell (what's app and text) which unfortunately only got up and running more that a week later as we had to wait for Vodacom to issue a new phone with the insurance.

6. This lady signed a contract with us. In this it stipulates (non-refundable admin fee) and that clients are to give one month’s written notice which she did (also have proof of contract she signed and letter dated and signed) therefore the money she paid would be just that, (the one months notice and administration fee). All the above points are not hidden in the fine print, but printed in BOLD letters on the contract to draw the clients attention to them – and the contract is explained to them with services and prices PRIOR to signature. She took up a position (space) which we could have easily filled with another child, so why should we carry the loss of income? We have not had to advertise for 2 decades as proof that our class spaces are at a premium. .

7. We are not violating her rights - we do not sell products, but rather, offer a service which the clients choose. We are not involved in direct marketing - our clients come to us willingly. We are the oldest pre-school in Kempton Park with unchanged ownership since 1987. We have second generation children attending as proof of what these parents felt about the pre-school they attended. They only wanted their children with us – no one else. We regret the aspersions cast on our institution but this will not induce us to refund this friend of the untruth. We further wish to advise that any further unfounded aspersions made against Happy Days or it’s owners or it’s employees will result in us suing for damages.
