Used Vehicle Purchase Nightmare

To whom it may concern.

I Lawrence Mtekwana, would like to be advised on recurring problem on a vehicle I bought from Gys motors dealership in March 2017,as to further steps to take on resolving the matter.

I first lodged a complaint with my financing bank(MFC)in April about the vehicle that it had lost its power whilst using it, the entire body of the car was vibrating then it flashe an engine icon on the dashboard ,referring on the manual-this icon indicates that the engine is faulty and secondly, the spare-wheel was not compatible with the vehicle.

My complaint was forwarded by the bank to the dealer, and the dealer did respond accordingly. We did as advised by the bank, to come to a mutual satosfactory agreement.

We then agreed that they will collect the car and repair it.Collection was done at my daughter s workplace on the 17/18 April 2017,by the owners son,Gys. The car was then delivered to her workplace after repairs by Chris(salesperson) on the 15 June 2017,with assurance from Chris that the vehicle's spare-wheel was correct & the problem was not engine related,it was caused by something next to the engine and they have replaced it,it was the oxygen system.

She took back my car and on the 02/July 2017, the same problem occurred, the car lost its power, the entire body of the car vibrated fratingly as if the car was to explode and the engine icon appeared again on the dashboard...

She called the dealer and he(Chris) requested for the location where the car is to be collected and advised will collect it on Thursday (13/7/17).On Thursday he called my daughter and changed postponed the arrangement to Monday (17/07/2017). When I call him(Chris) he doesn't answer my calls nor get back to me. I contacted the bank and was then advised to wait for the collection on Monday.

Monday(17/07/27), no collection was done more over no communication as to the reasons why they couldn't do what was arranged by them.

On Tuesday I called him, then he said they had a meeting with his managers and they can't tow it from JHB to PTA, they dont have the right people, every one is not available and their drivers went to Secunda.

My dealer(Chris) advised that we take it to a near accredited workshop, using my warranty, I did so,the insurance collected the car and sent it to workshop in Roodepoort, now the dealer is saying they are charging a lot for repairs and their evaluation is not true. but still they won't get the car from the workshop, now the workshop has additional amounts they are charging, the dealer is ignoring our calls, they are just turning a blind eye. They are not assisting as promised when I first had the same problem.

I also informed my the financing bank(MFC),they said they can't do anything about my situation,I should solve it with my dealer and that I am obliged and contracted to pay the instalment even if I don't have the vehicle.

Please assist.
Mr. L.N.
