Misleading sign-up,unfair cancellation policy and poor follow up-gym company
I am highly dissatisfied with the service received from Gym Company regarding our membership and recent cancellation request. On 25 June 2025, myself and my partner signed up for memberships after informing the consultant that we were relocating to Ballito, KwaZulu-Natal. We clearly asked whether Gym Company had a branch in Ballito, and the agent assured us that it did. Based on that information, we signed the agreement. After relocating, we were shocked to discover that no branch exists in Ballito. The closest branch is in Berea, more than 36 minutes away, which is simply not practical for regular use. We have only used the gym once since signing up. When we submitted a cancellation request, we were told we are subject to a 3-month written notice period, with reference to clause 9 of an addendum. However: • This 3-month clause was never explained or emphasized at sign-up. • The debit order instruction form states only a 20-working-day cancellation notice, in line with the Consumer Protection Act. • The membership was entered into under false pretenses, based on misleading information from Gym Company staff. To make matters worse, I communicated this issue via email with the lady assisting me and asked her to escalate the matter. She told me on Thursday that she had escalated it to her manager. By Monday, I still hadn’t heard anything and followed up. She then responded: “Good afternoon. My manager is currently not on duty today. Will check up with her tomorrow and resort back to you.” It is now Wednesday, and I have still received no response or update. This is unacceptable and shows a complete lack of urgency and professionalism. We are requesting: • Immediate cancellation of both memberships • That the 3-month clause be waived, and • That no further debit orders be processed beyond the 20-working-day notice, as per the CPA. Should this matter not be resolved promptly, I will be escalating to the Consumer Goods and Services Ombud and pursuing other legal and public avenues. Thank you c
