Re: Cancellation of gym contract

I refer to my mail dated 29 August 2020 issued to Kyle Daniel stating that I can forward my mail to you as no one is prepared to listen.

So even though I have informed Gym Company on numerous occasions that I cannot continue with this contract due to the Covid 19, the Gym Company don't really care much about people as all Gym Company is interested in is taking my money.

When mentioned before that I cannot continue with this contract you were more concerned to inform me that:

1. I will have to pay a penalty of about R1500.00 to cancel the contract.

2. You can freeze my monthly contract but I still have to pay R49.00 a month for the “freezing fees”.

3. My normal monthly debit order is R199pm.

Now my dilemma is due to Covid 19 (that was not my fault) I now have to:

1. Take care of my mom and dad.

2. I don’t have extra money lying around (even the R49 freezing fees).

Another worrying issue to me is that you insist in taking money during Covid 19 while the gym was closed. I must pay you for a service that you are not providing. How fair is that and now that I have informed you I cannot afford this anymore you still insist on me having to pay a penalty or reducing it to the "freezing amount".

To date no one has even bothered to respond to my request to cancel the contract.

I don’t have the R1500.00 (penalty) or R49.00 (freezing fees) or the normal R199.00pm money as all the money goes for taking care of my family.

If I don’t pay I am sure you will waste no time to take action to blacklist me and cause further hardship.

Is this the way Gym Company does business?

I await your response

Regards

Hi Kyle

I thank you for your response.

It is really a sad state of affairs that no one is prepared to listen. The entire country is battling. People in short time. Not receiving full salary and as I stated feeding and taking care of family is more important that a gym contract now.

So even though I have informed you that I cannot continue with this contract due to the Covid 19 that is not even my fault the Gym Company don't really care much about people as all Gym Company is interested in is taking my money.

Another worrying issue to me is that you insist in taking money while the gym was closed. I must pay you for a service that you are not providing. How fair is that and now that I have informed you I cannot afford this anymore you still insist on me having to pay a penalty or reducing it to the "freezing amount".

Virgin active is not even *********** their members the way Gym Company is doing.

I have nothing more I can say but thank you for not even listening to what I had to say.

Dear Charmaine

I do understand that these are difficult times.

I will assist you by freezing your membership for September and you will not be debited the freeze fee.

I really hope that this gives you enough time to at least get back on 1 foot for October debit and future debits.

Thank You

Kind Regards

Hi Charmaine

As per our telephonic discussion.

I have reduced cancellation fee and in order to cancel now the charge will be R946.00

The only other option is to freeze the membership at a R49 freeze fee

Please advise

Thank You

Hi Kyle

Thank you for you reply but please take note of the following... I cannot afford to pay the cancellation fee... As I said I got a salary cut and I have to support my parents as well.

I cannot even afford the freezing amount...

What do you want me to do???

The R99 debit was a fee recovery debit that was system generated before the account was balanced. I do apologize about the inconvenience.

In order to cancel the contract there will be a cancellation fee of R1592.00

The alternate option to cancelling is to freeze the membership

Please advise

Thank You

Dear Member

I am sorry to hear of the below.

The option of a freeze will be most suitable at this point seeing that your income has a cut.

The freeze has a fee of R49 however your membership is in credit and we have frozen and used the credit as your freeze fee.

Also note that freeze requests must be done on a monthly basis by emailing your details to *** at least 10 days before your debit date.

If you have any further queries you may email me directly

Thank You

Kind Regards

Dear Charmaine

We are already preparing for re-opening to ensure our members and staff will experience a safe environment with social distancing in mind as we value our members and staff's safety.

Your membership is frozen for Aug.

Any extension to this freezing request must be communicated on a monthly basis to *** due to the uncertainly of our re-opening date.

We are all in this together and we value our members and their health. Continue with your monthly debit order and automatically have your membership extended for free for the same period as the lockdown AND get up to 10x your gym fees back in monthly grocery and pharmacy discount vouchers by being an active gym4free.co.za rewards program member!

OR

Freeze your membership for the month of Aug by emailing your full name, ID number and contact number to *** A freezing administration fee of R49 monthly applies and your gym4free rewards benefits of up to 10x your gym fees back in monthly grocery and pharmacy discount vouchers will also be frozen.

Please stay safe.

Kind Regards

Andrea.
