Dear Sir/Madam,

I am writing on behalf of my son, regarding an issue that has caused significant hardship and reputational damage due to an unauthorized account created under his name.

My son was approached by one of your sales representatives at Maponya Mall. He was offered what was described as a free one-month trial at The Gym Company. The representative requested his banking details to activate the free trial, assuring him that no charges would be made unless he chose to continue the membership. My son never made use of the gym facilities and never consented to a paid membership.

Despite this, debit orders were processed against his bank account without authorisation. These were later stopped when we realised what had happened. However, we were shocked to discover that his name had been listed with credit bureaus for an outstanding amount related to this membership.

This listing has now persisted for over four years, severely affecting his ability to secure employment, as potential employers routinely conduct credit checks. We consider this listing ******** and unjust, as the underlying account was opened without informed consent and involved deceptive sales practices.

We therefore request that you:

Cancel and write off any account or debt associated with this incident.

Provide written confirmation that no amount is owed to The Gym Company.

Notify all credit bureaus to immediately remove any negative listing or judgment associated with this matter.

Provide us with written proof of correction from the relevant bureaus once completed.

Please note that if we do not receive a satisfactory response within 10 business days, we will escalate this matter to the Consumer Goods and Services Ombud (CGSO), the National Consumer Commission (NCC), and the Credit Ombud, as this constitutes a violation of the Consumer Protection Act and the National Credit Act.

We trust that The Gym Company will handle this matter with the seriousness it deserves and assist in restoring my son’s good name.
