********** CONTRACTS!!!

I joined the gym late last year (2018), if my memory serves me well, it was around September/October. I was approached by one of your recruiters during one of their activations. I was interested and asked a number of questions regarding payments and any other fees excluding the monthly fees. I was made aware of a maintenance fee payable in November on an annual basis but was informed that it would only be deducted November 2019. To my surprise my account was debited twice in February 2019 and upon inquiry was informed that that had been done as a way to get all gym members at the same pace in terms of the maintenance fee, of which I accepted regardless of the fact that I had no knowledge of this fine print rule prior to my account being debited. I spoke to one of the receptionists at Gym Company Ghandi Square and informed her that I would be cancelling my gym membership after she had informed me of a reversal for April fees that I have no knowledge of but will be looking into and communicating with my bank. When I spoke to her she then informed me of a cancellation fee that I would have to pay of 20% of the outstanding 21 months membership, here is my issue with this. I would not have a problem paying the said cancellation fee had I been made aware of it upon signing my contract with the gym. Furthermore this said fee appeared nowhere on the contract that I signed. I am very fami**** with the law and all fine prints, terms and conditions. However, it is the responsibility of the gym to make the terms and conditions available to all members. Even after this hadn’t been done, I took the time to ask your staff members whether there were any other fees apart from the monthly fees and they said, no. The contract was sent to me when I expressed that I would be cancelling my gym membership. The contract sent was had the incorrect initials and the signature was not one I had printed.

With that being said, I would appreciate a way forward suitable to all parties involved as I don’t want anything to do with Gym Company anymore and have no plans to continue paying the fee because I will not be coming to your gym.
