********** Bad business

Hi there

My name is Susanne. I have a bit of a situation.

I bought (bidded) a 2017 vehicle Ford Ranger (double cab), from GV Auctions, on Witkoppen Road in May 14th this year. We Paid R168 000.00.

The owner of GV Auctions (****er Mohammed) said that we will receive the papers for the vehicle in 2 weeks. During that period we had fixed the exhaust, and refurbished the tyres, with the impression the vehicle was ours.

When we went to fetch the papers, we noticed that the vehicle was a code 3 (built up). So we told ****er that, he did not disclose that the vehicle was a code 3 and we no longer wish to keep the vehicle. He apologised, said he had no idea it was a code 3, and was willing to give us back the money we paid for the vehicle.

We showed him proof of things we had done on the vehicle, which now brought the vehicle price to R185 000.00. He agreed to pay us back R180 000.00 and we agreed.

He auctioned our Ford Ranger the very same day and got more than the R180 000.00 for it. Shockingly he did not disclose to the public that the vehicle was a code 3, even though he now knew it was a code 3, even though he alledges he didn't know with us, and the new buyer bought it unaware that it's a code 3.

We now had no vehicle to get back home with and He agreed to loan us a car, we currently using his Renault Sandero because he sold our Ford Ranger. He promised to pay the money on the Monday. No money was transferred.

We went there again and he said come on Thursday. But He wasnt there. Kept giving us the run around. We went again on the Saturday May 25th. We insisted on him paying us. He wrote us a cheque. I cashed the cheque on the 3rd of June. The cheque bounced on the 6th of June.

Since then he keeps making promises to pay but dont honour it. Or ignores our calls or messages. I went to the Douglasdale police station, spoke to Captain Cloete, who told me it's a civil matter and we need to go to handle it in Court.

I sent him a message saying that we taking this matter to the police and to court.

He then calls my husband and makes a verbal arrangement to pay R60 000.00 every Monday for the next 3 weeks. 1st, 8th and 15th of July 2019.

Told my husband, I dont trust him and I want it in writing. So we drew up a letter as per his arrangement with stipulated dates and amounts, signatures etc and took it to him. He signed it. I have the original and he made a copy.

But No surprise...he did not pay on the 1st July as promised and neither did he take our calls.

I went back to Douglasdale Saps on the 2nd July and spoke to Constable Magoro. He called ****er and said him that he was given a 2nd hand dealers license by saps douglasdale to trade in the area, but if he is not being above board in the way he is doing business, the license will be revoked. He then promised to pay us the 1st installment of the R60 000.00 by 4pm on the 2nd of July. No payment received.

On the 3rd, he transfers R30 000.00 to us.

This is so frustrating and he seems like a ***** character and I'm not sure how many other people are in the same situation as me because of his bad business practice.

He shows no remorse, does not apologize for his late or short payments and cant uphold good business relationship even though he signed an agreement.

He received double payment for a Ford Ranger, 1st from us, and then from current owner but has not paid us back our money.
