Tire Dealer Selling Years Old Tires as New

Was sold a 'new' tire that turned out to be 6 years old and dry rotted and was informed by tire shop owner and his wife that it came with a 60,000 mile OR 1 year warranty (whichever came first). The tire was purchased 8/16/2013, tire came apart and blew from the inside out on 10/18/2013. This caused over $2,700 vehicle damage estimate and along with dropping to the ground upon exploding and coming apart from the inside tearing up the vehicle, the seat belt caught me as it dropped causing disc in spine (L5, S1) to bulge/rupture along with whiplash type injury to my neck, lost natural curve in my neck which leads to moderate blockage sleep apnea, muscle spasms neck down (nerve damage in back stemming from muscle spasms), migraines, and just had spine fused (back surgery) to replace the damaged disc in my back. Upon calling shop owner, he REFUSES to HONOR HIS warranty with the tire. I have taken additional steps (and will continue to) for further action/s in this wrong being RIGHTED, not just for myself, but for all other innocent consumers after me. I'm not the get rich quick scheme type, but AM about reimbur*****t for my medical stemming from this *********, unprofessional sale.
