The background of my matter is as follows: - I attended an auctioneer at Alegrand Auctioneer (Grand Auction) in Lenasia on 09/07/2016. I purchased a vehicle which in my perception as well as the documentation was a 2.0 litre Golf GTI. I then made payment of the full purchase price plus the auctioneer’s commission plus VAT (R 126 540.00) on 12/07/2016 and took delivery of the vehicle on the same day. Upon taking delivery of the vehicle I immediately realised that there was something drastically wrong with the vehicle as the engine had no power and very little compression. I immediately booked the vehicle in at Lenasia VW. At this stage I wasn’t really phased as the vehicle was purchased at a reduced price and Paying a little more to repair was still an economical option for me. Whilst the vehicle was at Lenasia VW the workshop manager informed me a few days later that the engine in the vehicle had in fact been changed and was not a 2.0 GTI but rather a 1.4 TSI which was not what I wanted to purchase. I immediately contacted the auctioneer who requested that I return the vehicle immediately. Before the vehicle was released from VW I had to settle the bill for the work that had been done on the vehicle which was another R 13 029.06. I returned the vehicle and the auctioneer gave me a credit note for the full purchase price plus the repairs (R 139 569.69) that were done on the vehicle. I informed the auctioneer that I want a full refund and that I was not interested in purchasing another vehicle from them. The auctioneer insisted that I attend the next few auctions where I would find another vehicle that I would like to buy. I attended a few of their auctions and have not found any vehicle that interests me. The auctioneer is however refusing to give me my money back. It is my opinion that the auctioneer has misrepresented the facts to me in order to sell that vehicle. I have also observed from all of their auctions that I have attended that they get the staff to pose as bidders in order to push up the prices. There were vehicles that were sold on auction but were back on their floor a week later. How the operate is that they have two branches. So, if the bid fall on one of their **** bidders, they move the vehicle to the other branch an auction it off again. In my bid to get the refund I had a meeting with the owners and it became very evident that the ‘auction’ is all a shamble. The owners stated that I should look for another vehicle on their floor and if I find something there would be no need to “stand in the sun and bid”. He said we can just work out a price and I can have the vehicle. So to me these clowns are second hand car dealers that are operating under the auspices of being auctioneers. The matter was reported to the South African Institute of Auctioneers (SAIA) but they could unfortunately not assist as these auctioneers are not members. After much threats from my attorneys the auctioneers have now sent me a 60 day post dated cheque for only the sale price and not for the repairs. This is almost four (4) months after I had paid them cash. This is pretty much how these people operate but with all this they pretend to be religious honest people. While all this is still going on the owners went for the religious pilgrimage even though they rob and ***** from unsuspecting customers. Please be wary and avoid any dealings with these predators.
