Developer refuse to give me my deposit back

I have paid R2500 last year october deposit for property.<br> The occupation promised was initially Jan 2016.Then this year it was moved to July 2016. I decided to cancel the property because I went to the site over the weekend to check progress and I realize the develooment is very slow and it does not look like by July all will be fine.My intention was to move in atleast May.But Now even July does not look promising.,Not even one building is ready and I am on unit#55. I have not yet signed with lawyers.I emailed the bank that I need to withdraw quotation.I also emailed developer that I need to get my deposit back of R2500.The developer tell me that they cannot refund me, based on I cancelled one month later after receiveing email of their changes on occupation dates.I changed my mind due to I went to site and its not looking promising.I need to move in .i am now buying existing house.I need that R2500 back.I did not sign that my money is not refundable.Nowhere it states non refundeable.Developer answer to em states:Please also read on page 11 of the contract, point 11.1, where it clearly states that if the purchaser breach the contract by not fulfilling it - meaning cancelling -\";0;NULL;NULL;NULL;NULL;NULL;NULL;NULL;NULL;NULL;NULL ***;172077;707758;33;168;0;0;1;0;1;Bad Attitude"
