Genric Insurance repudiation of TH Mabasa’s Claim

I have been a loyal client of Genric insurance Company for the past 2 years, honoring my premiums consistently. I submitted a claim for my vehicle, which they repudiated and proceeded to the ombudsman. They claim that I had not disclosed certain information relating to my being arrested for drunk driving prior to the inception of the policy and when submitting the claim. The matter or case was subsequently withdrawn after the blood sample came back confirming that I had not consumed alcohol. They had further cited that I had abandoned the accident scene and breached the requirements of the National Road Traffic Act. The above 2 reasons were dismissed by the ombudsman. I was only required to provide details on the drunk driving disclosure, which I did in detail. 1. The matter had been withdrawn and I don’t see how this would have prejudiced the insurance in anyway in determining and/or accepting my cover. Nevertheless, at inception of the policy, I was asked if I had a conviction or pending legal matters, whilst the claim form asks if I have any motor vehicle conviction. On both occasions I stated No, which was correct. The ombudsman finalised the matter and agreed that they don’t have to honor this claim. Genric has further cancelled my policy. I find this to be very unfair
