Factory fault not fixed

I have a vehicle with a factory fault and the problem is not solved.

Please see attached email conversation bellow. This email includes the one I sent this morning to the lady who rep**** to my customercare complaint.

Sent email:

Hi Altricia

The last time we had a chat was last year November. Since then I have been phoning around for some advice on what to do with my car that has a factory fault on it.

I am still not happy with the car I have. Every day I must drive with a car that I don’t trust and since I had the car I was unhappy. It’s a defective car.

I would first like to start off by correcting a mistake in the subject of this email it was never a utility 1.4 but a 2015 Utility 1.8. I have done some research since our last chat and phoned a bunch of people for advice.

I have learned that the consumer’s protection act has been broken. The consumer’s protection act states the following:

Imp**** warranty of quality:

(2) Within six months after the delivery of any goods to a consumer, the consumer

may return the goods to the supplier, without penalty and at the supplier’s risk and

expense, if the goods fail to satisfy the requirements and standards contemplated in

section 55, and the supplier must, at the direction of the consumer, either—

(a) repair or replace the failed, unsafe or defective goods; or

(b) refund to the consumer the price paid by the consumer, for the goods.

(3) If a supplier repairs any particular goods or any component of any such goods, and

within three months after that repair, the failure, defect or unsafe feature has not been

remedied, or a further failure, defect or unsafe feature is discovered, the supplier must—

(a) replace the goods; or

(b) refund to the consumer the price paid by the consumer for the goods.

At this stage I have spent over R2000 driving my car to the nearest GM and back to fix the problem and after more than 10 attempts the problem is still there. That was when I contacted GMSA and received the email bellow.

I have also included my insurer in this email.

I also want reassurance that if my car is fixed that GM will take responsibility to fix my car if the warranty expires and the same component is faulty again or the same problem returns.

From: Altricia Mackett (C) **********
Sent: 01 November 2016 08:26 AM
To: Piet Coetser ********** /> Subject: Westvaal Nelspruit | Piet Coetser | 2015 Chevrolet Utility 1.8 | +/-19 531 | wty 11/03/2020 | ADMJF4HR0F ********** | HVK 925 MP | GMSA 489 ********** 277817

Good Morning Mr. Coetser

Trust that you well.

As per our telephonic conversation, this e-mail serves to advised that we have confirmed with our District After Sales Manager who has confirmed the below.

The noise that you are hearing is because of the rework that was done on your vehicle.
A valve was drilled bigger to eliminate the noise when turning the steering. Because I was so happy with my first Utility I wanted to go bigger with my new one and got the 1.8 base. I bought this car in October 2015 but since I had it, I was unhappy and disappointed because now I had issues with this car and it started from the day I had the car. It is a brand-new car!

There was a humming sound every time I turn or use the steering and I listened to the sound for a while to determine if there is something that triggers this sound. I went to the people at Westvaal Nelspruit. Herman and his team started helping me with this problem. I went to them and the first time and they said don’t worry they will find out form GM if there is other cases. The second time I went back and they work on the hydraulics of the steering rack to hopefully sort out the noise but unfortunately that didn’t help. I phoned them because driving from Sabie to Nelspruit and back every time is expensive and said to them it didn’t work. They asked me to come back for the third time so that they can see what steering rack to order for me. Later I went back for the fourth time but there was some issues with the delivery and the steering rack didn’t come. On the fifth time, they replaced my steering rack. The scary part is that it happened before my first service. After the steering rack was replaced I started hearing a strange knocking/rattle sound. I waited a bit before going back to make sure I know what triggers this sound so that I can make sure the guys at Westvaal hear it and try to fix it. I went back for the sixth time so that Chris could go with me and listen to the sound. He asked one of the technicians to see if he can find the problem. I went back the seventh time and Tollie (technician) went with me to listen to the sound my car was making but after that he worked on my car it still made the sound. The eighth time I went back Tony (technician) went with me to listen to the sound and after he work on my car, the sound was still there. The ninth time I went back Ewert from GM went with me to listen to the sound.

The reply I got wasn’t something I was happy about because what he told me is that the steering and suspension of the new Utilities is not the same as my 2012 model and with the noise there is no solution. To get rid of the humming sound the hydraulics needed to change and now I have to listen to a knocking sound.

I am very upset about this because I have been driving a car that I am unhappy about for a full year so that they can tell me it’s a factory fault. I’ve been paying for a new car with more problems than my previous model that is now 4 years old and has no problems. I had to drive to Nelspruit and back for a full year about a factory fault and the people at Westvaal helped me all the way but I want a better solution because I bought a new car because I didn’t want this issues but now I’m done listing to this noise in my car I want a solution.

My best friend bought an Utility this year and I asked him to do the same test on the same road as I did to hear if his car has the same noise but at 20km/h he heard nothing. I told him step by step what to do so that he does the test with the same circumstances as I did even if my car is a year older than his.

The people at Westvaal helped me all the way. I am upset about my car having these noises and I can’t think that a new car comes standard with rattles and knocking sounds, that is unacceptable! How long do I have to listen to this sound before I get a solution. I’m sick and tired paying for something that isn’t what it should be. I spent so much money just driving to Nelspruit and back to Sabie just to sort out this problem and the noise is still there.

I’m sick and tired of driving with a rattle box when I’m paying for a new car!!

Kind Regards / Vriendelike Groete.

Piet Coetser

Mechanical Draughtsman

Tel: ********** | Fax: 086 **********

Old Lydenburg Road Sabie 1260 | Box 1191 Sabie 1260

Website: www.york.co.za

Please refer to the York Timbers e-mail disclaimer which can be found on York's wesite
