I'm writing with regards to the membership number stated in the subject line. The membership belongs to my father Nkosinathi Phillip Gamzana and this is the third time i am writing to gems regarding the same matter.
I enquired about my fathers records for which I was a member from period 2010 January to 2012 December, to which Gems had an agent contact my father and provide him with incorrect information. Now in terms of the Popia Act section 23; Access to personal Information, which clearly stipulates: A data subject, having provided adequate proof of identity, has the right to— request a responsible party to confirm, free of charge, whether or not the responsible party holds personal information about the data subject; and request from a responsible party the record or a description of the personal information about the data subject held by the responsible party, including information about the identity of all third parties, or categories of third parties, who have, or have had, access to the information— within a reasonable time; at a prescribed fee, if any; in a reasonable manner and format; and in a form that is generally understandable I do not understand why a Gems representative then advised him that he needed to contact the Department of Education for a request that he SPECIFICALLY made to Gems.
Furthermore, because of the enquiry we have made for my Records (Noxolo Daphney Makhetha ***) under his Membership, he was advised by Gems on the 24th March 2021 that he needed to make a payment of R6,463 as a cost incurred by him to Gems, because Gems advised he owed on the account. he was later reimbursed R14,618(why?). The Gems representative who contacted my father also advised that a deposit of R7000 was deposited in July into his account by Gems, which he found was untrue.
There are a number of issues here which we need resolved and we would like them promptly resolved, because he was charged fees for his daughter who was not on the Membership since 2010, and now you're taking him for a fool, by conning him further out of his money.
We will seek legal action should the matter not be resolved.
