Poor workmanship
Att: [Owner / Manager] Dear Sir / Madam, FORMAL DEMAND IN TERMS OF THE CONSUMER PROTECTION ACT, 68 OF 2008 I refer to the gearbox repair performed by your workshop on my vehicle, a Volkswagen Polo 1.2 TSI DSG (2015 model), completed on or about 12/01/2026 At the time the vehicle was delivered to your premises: • The air-conditioning system was fully functional • The side shaft / CV joint was intact and operational Within 48 hours of collecting the vehicle after your repair, the following failures occurred: The air-conditioning system ceased functioning. I have been advised that the air-conditioning gas was removed and not restored. The side shaft / CV joint failed, rendering the vehicle immobile. I incurred towing costs of R300 as a direct result of this breakdown. I have been deprived of the use of my vehicle. These failures occurred immediately after your gearbox repair, during which the side shaft and surrounding components were necessarily disturbed. Your denial of responsibility has been noted. In terms of Section 54 of the Consumer Protection Act, I am entitled to services performed with reasonable care, skill and diligence, and to a vehicle returned in proper working order, free of new defects caused by the repair. I hereby formally demand that within ten (10) business days of receipt of this letter, you do allof the following: • Repair the side shaft / CV joint at your cost • Restore the air-conditioning system to working order at your cost • Reimburse the towing cost of R300 Should you fail or refuse to resolve this matter within the above period, I will proceed without further notice to: • Finalise my complaint with MIOSA, and • Institute a claim against your business in the Small Claims Court. All my rights are strictly reserved.
