Refund from Garlicke and Bousfield

Hello Peter,

kindly please help me to get my refund back from Garlicke and Bousfield. they do have all my details. i even left a copy of ID, banking details, cell number and email address.

On Saturday the 14th November Garlicke and Bousfield had a launch for new houses/ flat apartment in Hayfield Pietermaritzburg, their Estate is called Hesketh Estate. I was advice by their Agent by the name of Zama Zuma, She said at it is indicated in their website that when you wish to buy/own one of their apartment you pay R5000 deposit to secure your apartment, once that is done you are guaranteed that your apartment will be yours, however, you will be required to pay the full amount of that apartment before you move in when you buy it cash, but when you buy using bond, you will need to go through all the process of bond approval, I opted for cash because I have an idea how I will raise that amount by 2023, I chose unit 4013 which was ground floor with 2 bath and 2 toilets. Zama the agent said I must pay R5000 to secure this place, the development will start mid 2021 and be finished in 2023. I did pay the R5000, after that I was sent to Andre, to complete the application forms, when I get there they said I need to pay another deposit of the amount for the apartment I have chosen, I then decided to cancel the whole process because I was not told from the beginning that there will be another deposit required to pay within 21 days. they agree to cancel and to refund me, but they said because it was weekend, they finance department does not work on weekend, they will transfer the money back on Monday.

On Monday I spoke to the lady by the name of Nelen, who assisted to do the transfere deposit, I guess she is part of their finance employee. I ask her if they forgot to do my refund, she said they did not forget, they will refund on Tuesday. on Tuesday it was quite again, I asked her if the have processed my refund, she then told me that in order to get my refund their conveyancers require my FICA, Certified ID, Certified utility bill no longer than 3 months and proof of income tax numbers, I did arrange that even though it did make any sense to me, i then request for email address to forward them what they require, Nelen said they need to arrange a courier to come and collect the documents from me, and that courier needs to be arranged 24 hrs prior. this whole has prosses worries me, what if i don't get my refund at all, what else would they need after the courier has collected what they want. i really don't understand this process, because on Saturday i did leave my banking details, email address and my contact details as Stephan requested so.

please help me get my refund back Hellopeter.

1.            Garlicke & Bousfield Inc did not launch Hesketh Estate as claimed by the Complainant and we are neither the Developer/Seller nor the Estate Agent for this proposed development.

2.            None of the people mentioned in the complainant’s complaint are employed by Garlicke and Bousfield. 

3.            The Developers of Hesketh Estate instructed Garlicke and Bousfield Inc to act as the Conveyancers for this project.

 4 The Complainant was required to pay a deposit of R5 000 in terms of the Agreement of Sale entered into between herself and the Seller.  In terms of the conditions of sale this deposit was to be non-refundable in the event of the Complainant not securing the balance of the purchase price timeously.

5.            The Complainant did not secure the balance of the purchase price as provided for in the Agreement and, in fact, requested the Developers to agree to cancellation of the Agreement.

6.            The Estate Agents negotiated with the Seller to refund the deposit of R5 000 to the complainant, which the Seller agreed to (long before the Complainant posted this complaint on Hello Peter) notwithstanding the fact that the deposit of R5 000 was non-refundable.

The deposit could however not be refunded until the Complainant furnished the required documents required in terms of the Financial Centre Act, Act No 28 of 2001 (“FICA”)  (i.e. certified copies of both her and her husband’s Identity Documents, proof of addresses and income tax reference numbers.

8.            The Complainant has since comp**** with the required FICA requirements and the deposit has been returned.
