Rude store manager and misleading advertising at Game eastgate

On Saturday, 17 December 2016, I went to the Game at Eastgate shopping Centre to do Christmas Shopping for my niece. While shopping, I saw a jungle gym set marked at R999. The set up contained swings, a see-saw type swing and a slide.

I called a staff member to assist me with finding where this set was kept so I could get one. I confirmed the price with the staff member (unfortunately I did not get his name) and he confirmed that the set was on sale for R999. I asked whether the whole set was on sale for R999 and he confirmed this. I then confirmed that the slide was included and he said no. He advised that the slide was an additional R999. I then informed him that the display is misleading and that the slide should be marked separately. His response was “well you should not ask me questions you know the answer to”. Sarcastically, he proceeded to ask me, “if I put a sign up saying R50 , would you think that the whole shop is for sale for R50?” oh and “do you also think that the boxes underneath the set up are included in this price to?”

I did not want to be that customer to throw up the Consumer Protection Act, but I told the gentlemen that in terms of the Consumer Protection Act, this amounts to misleading advertising and it is prohibited. He then told me that in order for the Consumer Protection Act to be applicable consensus needs to be reached between the parties. I advised him that this is incorrect (and whilst I may not be an expert on the Consumer Protection Act) I did study law and misleading customers is not allowed. He rudely told me that I do not know anything and that he knows the law. He told me that this set up is in any event sold out and the best he can do is give me the one on display at a 5 percent discount. I asked whether that would include the slide (at the 5 percent discount) and he said no. I asked to see the manager and he told me that he is the manager of the store.

I was appalled at the service that I received, as this gentleman was rude and laughing at me whilst making these sarcastic comments.

Surely misleading advertising is a mischief that the Consumer Protection Act aimed to eliminate. Not only was this display misleading but there was also no stock.

While I understand that the stores were busy and the staff were under pressure, this gentleman did not even attempt to apologise for the display being incorrectly marked, instead I was met with arrogance and a blatant unwillingness to assist. I understand that customers may not always be right, however I did not appreciate the way in which the manager spoke to me, or the fact that the display did not include everything it purported to. I was simply disgusted.

I am glad to report that my complaint has been taken care of. I was contacted by the Store Manager, Muhammed who managed to pin point the staff member who assisted me on the that day. The staff member formally and sincerely apologized for being rude. Muhammed went the extra mile to ensure that I got the play set at the advertised price and was professional and friendly in his dealings with me. Thank you to Game and Muhammed for great customer service in resolving my complaint.
