Refusal of a refund on a phone with a Manufacturing Defect
I bought a Samsung S23 cellphone online for R13999,the phone was deliverd to me from GAME Amanzimtoti.Within less than a month upon receiving the phone it froze, could not charge and stopped working.I reported the matter to them ,and sent the device back with a courier at their arrangement.Upon receiving the cellphone, the store did acknowledge that the device was not working(this is evident in the Repair Agreement they sent to me when they were booking-in the phone for repair with the technician) Miraculously when the device came back from the technician, the report came back as saying "NO FAULT FOUND".I then took back the phone, and it was now working but within 8 weeks, the phone had the same problem again! It froze, could not charge and was not working.I personally took back the phone to make sure they could see and acknowledge that it was not working. They then took it back to a technician, they report came back as saying that the phone has indeed a Manufacturing Defect, which they reported to having fixed.I made it clear to them that I no longer want the phone, and requested my money as stipulated in Consumer Protection Act,but they are refusing me my money back and forcing me to use a repaired phone
As of now,you have both the phone and my money;and I as the customer have neither. How is this fair?
