RECEIVED A SECOND HAND PHONE ON MY CONTRACT

I upgraded on my cell phone contract (cell C). when I eventually opened my cell phone it had a pattern lock on. According to Samsung this is a second hand phone. the employee did not open the cell phone in front of me, if was opened when I received it but it looked new as there was stickers on. When I raise this with the store they were not helpful.
