Ongoing CPA Breach & Goalpost Shifting – Replacement Required for Defective Camp Master 210 | Ref 25SSN

This is a further update on my ongoing complaint (***). I returned a Camp Master 210 gazebo to Game Key West on 26 December due to visible defects. Since the return, the resolution has been subject to repeatedly shifting timelines. Game Customer Care assured me that the gazebo would be collected and resolved by 5 January, which did not occur. I visited the store again last Friday and spoke to the store manager, Boishoko, who indicated that he was not aware that follow-up was required and stated that it was not his responsibility to follow up on the matter. I am now again being advised that the delay is due to supplier availability, with dates continuing to change. Responsibility continues to shift between store, customer care, and supplier, with no concrete resolution since the return on 26 December. This ongoing delay is unreasonable and not aligned with the Consumer Protection Act, which places the obligation on the retailer to resolve defective goods within a reasonable time. At this stage, I am formally requesting an immediate replacement of the defective gazebo. I am no longer willing to accept further provisional dates or supplier-dependent timelines. I am requesting direct intervention from Game Head Office to finalise this matter without further delay.

Hi Leehong, I'm sorry that your query hasn't been resolved as expected. I understand your disappointment and frustration; with the lack of urgency. The matter has been re-escalated to the maagement team at the store and we have requested feedback urgently.

Thank you for the response. For clarity, my final position is now a refund. This matter has been “escalated” multiple times since 26 December 2025, without resolution or proactive communication. The following remains on record:
  • The gazebo was returned on 26 December 2025.
  • I was advised that suppliers would reopen on 5 January 2026.
  • The item was only collected on 8 January 2026.
  • I was assured in-store on 9 January 2026 that I would receive feedback on 14 January 2026, which did not occur.
  • I have repeatedly had to initiate contact myself, with no proactive updates provided.
Due to these delays and missed undertakings, a replacement is no longer a reasonable or workable remedy. I have therefore formally elected a refund under the Consumer Protection Act. Further escalation without resolution does not address the issue. I am requesting confirmation of the refund process and timeframe, failing which the matter will be referred to the Consumer Goods and Services Ombud.

Hi Lishon, The manager at the store have advised that you were there yesterday and that you'll be back on Monday for an exchange.
