No Refund for selling customer damaged cell phone

3 weeks ago I bought a brand new Samsung J1 at GAME Kolonnade. In the first week after I bought the cell phone it started to freeze, and whenever I received a message the phone will vibrate continuously without stopping (I had to push all the buttons I can on the phone to try and make it stop). I consulted with GAME Brooklyn and they advised me to take the cellphone to vodacare. After another week, I phoned vodacare and asked why a software upgrade takes that long, and they informed me that they are waiting for repairs as the LED screen and other phone parts inside are damaged. Also, they couldn't find any proof that the phone has fallen or got any water damage. It has been two weeks now, and they are still waiting for the parts to repair the cellphone, and GAME Kolonnade refuses to refund me on the broken cellphone, that is only 2 1/2 weeks old and have not fallen once or gotten any water damage, as has been founded in the report by vodacare.

How is it that GAME Kolonnade sells to you a broken cellphone, takes no responsibility, refuses to refund or replace the cellphone and insists that I be patient and wait for the cellphone to be repaired. How, in any way, is this right?Shocked
