Faulty laptop

My daughter bought a laptop from Game Centurion for my son as a gift . This laptop is one year 3 months old . The laptop was insured with my insurer for damages and theft . The laptop is now damaged , when we lodge a claim the insurer rejected the claim stated that the laptop had a factory faulty . When i contact game they told me that there is nothing they can do. I spoke to Shameeg who told me that if the warrantee has expired i cannot do anything . I also feel that if the laptop didn't have a factory fault my insurance could have replaced it . I need this laptop to be replaced
