False advertising and blatant violation of the consumer protection act from Game Stores
Do not order online from Game! They will deliver a faulty and defected product and make it a song and dance for the customer to issue an exchange. I ordered a fridge from Game Online which was delivered on 2 November. The driver showed up in a run down and filthy bakkie, where the fridge was laying flat on its back. A fridge should not be transported this way as this can cause a gas leak. The fact that the driver did not have enough training to know that the fridge should be kept upright, speaks volumes about the lack of efficiency from Games part.
Upon opening and setting up the fridge, I started to notice several damages. There was a sticky substance like a glue of some sorts that it seems like they were trying to remove and ended up damaging and removing some of the paint in the process. This is not even my biggest concern. My biggest concern is the rubber framing that protects the fridge door when closing and is meant to seal in the temperature. This rubber is lifting and the metal underneath is bending, so it cannot even be forced back into place. This is causing the fridge door not to close flush and this is going to start leaking eventually.
Game has a policy that any defected items must be reported to them within 7 working days of receiving the item. I reported it as soon as I spotted it. It was well within their 7 day exchange policy. and yet till today, I am not receiving any feedback on when the exchange will be issued. Game's last response to me was on the 8th of November. Today is the 14th. I have sent 3 follow up emails since then, and they are blatantly ignoring me. This is absolutely *****ulent and a blatant infliction on my consumer protection rights. This was not a small amount of money. I paid R5200 for a fridge that seems to either be used or seems to be some sort of display stock, and that was not what I selected and paid for on the website, which is false advertising as per section 48 of the CPA.
I am sure Hello Peter will block out the names of the 2 Game consultants that are meant to be handling my exchange (Kaylin Klaase and Eghon Abrahams) who have not responded to me since 8 November. but I'm sure social media would love to hear these names and see the screenshots, so I will be posting all the details publicly. I am interested to hear what my 20 000 social media followers think about this. That is the number of customers you will be losing when I am done here.
I am taking this up legally to ensure you do not get away with doing this to any more customers. How many people have you done this to who do not have the know-how or the resources to fight this matter? Fortunately for me I work for attorneys and know my consumer rights. I have fought 2 cases like this before and won. You have tried to rob the wrong person and I will make sure you can't do this to anyone else ever again.
