damaged cell phone

I bought a cell phone at game store on Wednesday when I get home the phone was not working, I took it back on Thursday, and told me that the person who is working with very phones is not available I must go back home , I went back again on Friday they told me I must wait for that person for 30 minutes still they couldn't help me, now I don't know what to do I want a new cell phone or Cancel the contract
