Ford is *******ly Withholding My Vehicle

I bought a Ford Figo Trend in June 2012, from Ford Kempton Park. During the enquiry process, I was provided with the attached quote which I accepted telephonically to the sales representative Clinton Nathaniel. A copy of the purchase contract was not provided to me. I was a first time buyer, I was more concerned with securing vehicle finance for the purchase.

Since purchase, I have been taking the vehicle for service to Ford Bruma. Yesterday, I took the vehicle in for service at Ford Bruma and communicated to Lee-Anne that I will be using the maintenance plan. At 12h45, I received an SMS from Lee-Anne, advising that the vehicle will be ready for collection at 14h00.

At 12h55, Lee-Anne called me, informing me that my maintenance plan expired with my 60 000km service. She also advised that I will not get my vehicle unless I pay for the service.

I contacted Ford Kempton Park and was advised that my file has been archived and can only be retrieved "in a few days".

As things stand, I am not able to prove to Ford Bruma that I took up a 80 000km maintainnance plan. Ford is not able to prove that I took out a 60 000km maintenance plan either.

It should not be my problem that Lee-Anne did not verify the validity of the maintenance plan before the vehicle service started. I do not have the money to pay for the service and there is no proof that the maintenance plan expired.

I am willing to pursue this matter legally. It does not make sense to withhold a whole vehicle because of an outstanding R1 600. There is no reason why my vehicle is being withheld because I am not responsible for Ford's systems.
